“In our view, the decision of the prime minister to advise Her Majesty the Queen to prorogue parliament is not justiciable in Her Majesty’s courts.” The view of the High Court in London, not that BJ didn’t give HM bum information but that the courts should not make a judgement on it. The Court of Session in Edinburgh thought the opposite, on the basis of Scots Law, and did make judgement.
If the Supreme Court sides with the Court of Session on this (although I can’t see it) it will really rattle the cages. This really is a square peg in a round hole stuff as how can the Supreme Court judge on two different legal systems? Tbf Scotland wouldn't do anything of the sort to an rUK. Without good relations with England, Scotland's future would be about as viable as an egg sharing a bed with a hippo.
