I've read the thread. It seems the right thing to do is leave NF but invariably he will relaliate with the same and I can add a footnote.
Or I can do nothing and preserve my good FB rating.

Please leave a neg!! They deserve one and it will show other buyers what they are like. If they give you a neg back then word your reply well and it will be obvious who was to blame here. Having a neg that is an obvious retaliation won't do your account any harm so don't worry about preserving your score. OK! I have just left a negative. You have a persuasive argument and bidding had started on some of his listed items and prices are going quite high. I did it despite a possible retaliatory because this seller really deserved it.
I wrote:
NON-PERFORMING SELLER! TOOK PAYPAL PAYMENT & MADE NO FURTHER CONTACT! AVOID!
If I get a retaliatory and can then respond, I propose something like:
PAYPAL DISPUTE RESOLVED IN MY FAVOUR.
What you you think? I got my money refunded by Paypal. Do I need to mention that?0 -

If he does neg you in retaliation then it depends what he says so I can't really comment on what you need to follow up with. You have to be a little bit careful when mentioning disputes in feedback - it can be grounds for removal, so err on the side of caution!
