    No, ebay can't force anyone to sell to you. The negative feedback that I trust you intend to leave - after getting your refund - will cause him some hassle, though :)

    I have just read a thread where the seller drained the Paypal account so winning the dispute was useless to the Buyer.

    In view of the fact that I purchased on 30 Aug, opened the paypal dispute on 6 Sept (yesterday 8.00am), I would not like to lose too much time.

    Should I now tick the box to end communication and escalate the dispute to a Paypal claim? There has been no contact from the seller since I won the item and before that he was emailings answers to queries daily.

    If you're on-line now, the progress is the Paypal has notified me of resolution of my case in my favour. The good news is that Paypal was able to transfer my money from the seller's Paypal a/c back to my Paypal a/c. So I am not out of pocket.

    There was no communication from the seller.

    I now want to leave negative feedback for the non-performing seller. As he hasn't left me any feedback and still has the opportunity to do so, won't he be inclined to leave negative for me in return and if so, how could I apply to have it removed?
  • The seller will still be able to leave feedback (I think the rule about not responding to disputes preventing you from leaving f/b only applies if the buyer doesn't respond) but you shouldn't let that put you off leaving a neg if he deserves it (and I think he does). Remember that feedback is meant to warn other people of a bad trader - you've waited 4 weeks for this to be resolved - don't let him do it again!

    Ebay would not remove any retaliatory feedback - but you could easily put a follow-up under it making it obvious that it is a retaliation, and not a fair neg. He may not bother leaving a retaliation - does he have anything else for sale, or is there any recent activity on his account?

    He registered in 2004, was only a buyer, only about 1-2x per month. The bath was the first item he was selling.

    Now he has 4 active listings, selling car wheels and electronics.

    In his listings he is threatening to leave negative feedback to non -performing buyers!
  • In that case he's an idiot for not responding to you. You could very easily leave a neg and deter his buyers.
