  • You only have one option to get any fraudulent activity removed from your account and that is to involve the police and see it through to the bitter end only if you are prepared to do that will you be able to remove any detrimental information. Either that or suffer with a poor credit rating for the next 6 years

    Have you checked Clearscore (Equifax)?

    If you are looking to buy a property in the next month you have next to no chance of getting this resolved in that timeframe.

    You need copies of your credit reports from all 3 agencies and then once you can see the true picture:

    1. Contact the lenders involved who have defaulted you / any other accounts you may find and inform them that the account was opened fraudulently, provide them with the crime reference number from Action Fraud / the police and request it in writing that they confirm the account will be removed from all 3 of the credit reference agencies.

    2. When you receive the letter(s) you will then need to wait a further month and check your credit reports across all 3 again. No doubt some / all of them will not have bothered to update their information so be prepared to contact Experian, Equifax etc and forward them a copy of the letter from the lenders stating that the adverse info will be removed.

    3. Be prepared to be met with 'please allow us x-amount of working days before we can respond to your request' so at this point unless you are going to seek legal help from a solicitor to speed up the process, all you can do is wait for their reply and then request further copies of all 3 of your credit reports to check to see if the defaults have been removed.

    Just an update - I wrote to the company with proof of my current address and that I didn't live at the address on their records, and they kindly amended my credit record and seem to have written off the debt as my brother also sent a letter asking them to move the debt into his name, but he has had no response. Happy days, I can get in with buying a house now...

    Personally I would never go directly to the police with something like this.

    With unauthorised transactions, the fraud is on the CC not on the cardholder. For people who would otherwise go the police route, I would dispute the transactions giving information as to what I believe has happened and tell them that it is a matter for them if they wish to go to the police. I would also tell them that if they do, then I would cooperate as required.

    Whatever the behaviour of the family member it is, afterall, the CC that opened the account in the wrong name. It is for the CC to decide what checks they carry out - and such checks are not always sufficient.
