    At a brief glance it appears that you will be assessed as your acquired gender once you have obtained a Gender Recognition Certificate. Which presumably leaves it open for some abuse - i.e. there is an incentive for M>F to get a certificate or make a claim, but not F>M - but I imagine the impact of this is so small as to be not worth considering. If the certificate is obtained between the men's and women's SPAs then entitlement will change with effect from the date of the certificate - so someone born as a male who became a female after the usual women's SPA for someone her age, but before the usual men's SPA, will not have her entitlement backdated to the women's SPA and so the pension will not be automatically judged to be deferred.

    Interesting that from the first document there are estimated to be some 750 people who were born between 23 December 1919 and 3 April 1945 who are male to female transgender who may be entitled to both payments for state pension deferral and refund of NI contributions charged while working after reaching their new female gender's state pension age. Also interesting that it doesn't mention female to male transgender, seems sensible enough given the likely low number of people involved and hence low recovery potential.

    From the second document it seems that in the F-M case NI contributions through PAYE would resume until the male SPA was reached. And stop from the time the certificate is granted for the M-F case if after female SPA. And yes, state pension payments also from them:

    "If you change your legal gender from female to male after you’ve reached State Pension age for a woman but before you’ve reached State Pension age for a man with your date of birth, any State Pension your spouse is already receiving based on your National Insurance contributions will stop along with your own State Pension"

    Different rules in Northern Ireland.

    It's so tempting to ask WASPI and/or Nadine Dorries whether they agree with these treatments.

    I don't think that's very fair Colsten (about the sob stories).

    The whole women's pension business is inconsistent.

    I've been looking at me and two old friends all born in 53. One friend was born in Feb and has to wait 9 months after her birthday to get her pension, friend born in April has to wait only 3 months. I was born in October and have to wait another 21 months. How is that fair?

    Martin Lewis was on TV this morning talking about pensions and the WASPI campaign and he doesn't think it's fair either.

    This is a badly worded campaign and I didn't sign it but I know a lot of women did.

    How is it fair to further delay the time when men and women have the same state pension age? How will it be fair after that to have men getting a lower proportion of their working life on the state pension than women?

    It would have been better if the rate had initially been faster but it beats men taking the government to the courts and getting a discrimination ruling that could raise the age for women in one large chunk. The current timings might seem unfortunate but they aren't as unfortunate as ending this part of gender discrimination in one day.

    Hello James. How about you answer my questions rather than asking more questions? Do you think what I outlined is fair? I would expect increases to be consistent.
