The best bet is appealing to whatever better nature or goodwill either the restaurant or PPC have. Or, as I said, the tried and tested technical arguments.

I dont think we are disagreeing. The EA thing and banging on about discrimination was for the complaint to the Hotel. I agree there is not much scope here to include it in a POPLA or other appeal.

The OP can win on other issues if they have to take it to POPLA, as long as they do NOT give away who was driving in the first appeal as per the NEWBIES thread. That is, if this is a BPA member?

An interesting thought Dad but for the interests of others, show us what cases like this failed please

I am talking about the OP winning not losing. The reason I can't summon up a lost case is because I have never seen such a case get to court because either the PPC didn't issue court papers or they/shop extended goodwill or because the motorist took proper legal advice and paid up to avoid losing in court.

Not so; Breastfeeding comes under the Equalities Act 2010 and is given special protection on par with blue badge holders.

Not making concessions for a breastfeeding mother is a violation of the act.

As I have said before in other threads, there are 2 separate potential court case that could arise from this, but they are not tradeable off in the same hearing. The first relates to a motorist and a parking matter, the second would be an equality matter between a motorist and a provider of facilities.

In fact, given that PPCs don't actually provide the parking or even manage the facility, the equality dispute would be between the motorist and the shop/restaurant/landowner.

And how would that prevent a parking ticket from a scammer, if she had fed the baby in the car first, rather than in the restaurant first?

    Whoa!

Do you honestly believe she would have received a ticket if she were sat in her car, regardless of the feeding?

Personally I find that less likely than someone abandoning their car in a pay and display car park.

OH YES, the scammers only employ ignorant droids who would probably think it was a blow up doll sitting in the car.
You give too much credit to complete idiots
  • Lush Walrus,

I believe she would. One of these idiots tried to tell me that if I was waiting with my car the wheels would be moving; completely ignoring the legal definition. He then noted down my number to send me a ticket.

It's only because I had a world class public rant at the Morrisons manager that I never received a begging letter from the scammers.

So yes, they may well have ticketed her while she was in the car.

Yes. This isn't a Council real 'warden' (CEO) we are talking about. It's this type of scum:

    Hello all,

Quick email to premier inn list of directors, passed to customer relations and ticket immediately cancelled with an apology and offer for a complimentary drink next time.

Unfortunately for all of you !!!!!! who think i should have to pay please try and breastfeed a screaming baby in an extremely small car when your latch isnt great or alternatively even remember your own name when dealing with a screaming baby (who by the way has to be fed completely on demand due to being under a paediatrician for weight loss) let alone thinking 'Oh mate btw put a ticket on my car' instead of trying to calm down the baby. How dare you suggest I was using my breastfeeding as a golden ticket... I was putting my daughter first over paying for my parking. I don't know if you're happy to leave your children to cry and go hungry whilst you prioritise other less important things but in my eyes that is neglect.

I wasn't disputing the fact it was a correctly issued ticket. I was parked there without a pay and display ticket on. Rightly so the guy giving me a ticket didn't know the circumstances in which I had abandoned my car. The issue was the hotel taking the ticket and agreeing to cancel it then me getting a phone call saying I would have to pay it.

    The PPC was localparkingsecurity.
Anyway it is sorted now. Thanks for your help!

Totally agree with you about the !!!!!! with the pathetic judgemental 'advice'!

I am a Mum of 4, been there, done that but never got a PCN at the time. But baby comes first and life as a new Mum is stressful enough!

WELL DONE on the cancellation. Indeed this was one for a Hotel complaint first, and you have shown that works.

    :)

Amazing what you can get done while all that bickering is going on in the background (and I don't mean your child(ren) :))

well done on getting the ticket cancelled but perhaps if you are in such a stressful state as you say above you are not in a good place to be driving safely anyway.
