Libby Barr & Taking BT to Court

I am about to issue proceedings against BT in the small claims court on Monday 22nd Feb for Breach of Contract. I wish to name Ms Libby Barr as the defendant and therefore require her contact details in order that the summons arrives at the appropriate address. I would be grateful of anyone that may be in a position to provide the same.
Happy to relay my nightmarish experience of this shambolic mob in a later posting but to GREATLY abbreviate matters namely but not exhaustively I have been:
1/ deprived me of any service for four weeks due to their maladministration
2/ I have been systematically lied to.
3/ I have a record of being on the phone regarding attempting to resolve THEIR error for over eight hours.
4/ Promised calls (from BT) not returned.
5/ BT staff terminating calls simply because they do not know what to do.
6/ Receiving a plethora of unwelcome / unsolicited 'welcoming' messages for a service to which I had been subscribing since the inception of the internet.
7/ Had engineers instructing me to conduct repeated resets of my equipment with loss of valuable data when throughout my 'loss of service' is was a "BT data integrity issue" and I repeatedly told BT that my loss of service and the renewal of my existing contract was no 'coincidence'
8/ Had to wait in for an engineer who laughed and said there was nothing wrong with the equipment and that it was an "administrative issue".
9/ Had complaints 'escalated', had the issue repeatedly passed on to 'level 2" managers only for me to receive no further contact and be left waiting for promised calls which never come (nine counting to date.
I could go on... (and on)...(and on)...
but I only have one life - so now I am cutting to the quick and having my day in court with them.
How naïve I was to have a sense of 'brand loyalty' due to my late father having worked for GPO phones & then BT all his life - he literally died whilst working for them!!!!
However thus far and no further.
Any assistance will be greatly appreciated and acted upon in the strictest confidence.

    You don't have a contract with L Barr!


    Even if you manage to get her details you will be wasting your money issuing a claim for "breach of contract" against an individual employee like this.


    Get some proper advice on how to use the small claim court before throwing money away on a claim like this.

    Dare I even ask on what grounds you're actually taking them to court and what it is you're expecting to gain? Bearing in mind "bad customer service" and being "lied to" (which your complaint essentially equates to) is not something that can generally be monetarily compensated by a court.

    As above, your case will fall to bits faster than a wet cake if you name an individual employee in the proceedings - based on that suggestion alone I'd say avoid going to court as you clearly have no idea what you're doing.

    "Naïve" indeed you are - learn to pick your battles and move on.

    I currently have an issue with BT, in which I also believe they are in breach of contract and therefore are liable for the fees I'm incurring as a result. I have posted my issue on this site but don't know the law well enough to know for sure that they are in breach of contract, just logically I think they are. I have started going through the 'resolver tool' system which I found on MSE. Though from the frustratingly evasive responses I've had from BT so far I am anticipating that I will have to take the matter up with the ombudsman, or whoever BT answer to (I did ask BT repeatedly who they answered to but they ignored this question). I think that there are channels you can go through without having to take anyone to court, but I'm guessing they aren't that speedy, and from my perspective, it would be really useful to know where I stand first so that I know what records I need to keep just in case.

    BT is a corporate legal entity in it's own right, and if you wish to make a civil claim against them then the defendant is simply BT Retail, or whichever limited company is named on your contract.
    No free lunch, and no free laptop ;)
  • Ridiculous court action destined to be thrown out without ceremony.



    The obvious way to deal with such concerns is to just send a letter of complaint to BT .

    I'm not even sure why any individual employee was named? Was she the staff member who hung up because she didn't know what to do? That's not cause for being taken to court.

    As for anyone here providing her contact details...:eek:

    Have you tried the Ombudsman Service Communications (OSC) if not I suggest you do.


    Once your complaint has been considered by the OSC you will be able to consider further action with more details, also the action should be against BT with whom you have/had your contract.


    All actions as I understand it are dealt with by.....

    Any reason why you bumped this thread a full two months after it was posted?

    In the first instance, the OP should have written a letter of complaint to BT and only after they had had eight weeks to consider the concerns (with no satisfactory outcome) would any Ombudsman need to become involved.

    I'm certain this will have been done and dusted back in February, with "L Barr" hopefully not ending up in court.;)
  • Thanks v much for the contact info, etc. My anger regarding this mob knows no bounds. They are an absolute disgrace - it it not the individuals but the entire festering culture at BT - and that tends to infect from top downwards.

    Best thing you can do when you are being messed about is write to the head of finance at the first instance of being messed around.

    You advise them they are in breach of contract (giving details) and then inform them that you are now charging them for your time at £250 per hour.

    Then you record timesheets and send an account to the FD as you go through the stages you mentioned above, you advise them that if they do not settle the matter you will continue to charge for your time to complain to OFCOM et al.

    Finally when connected or you hit a stalemate you total it up, issue an invoice, give them 14 days to pay and if not you take them to small claims court. It will cost you money but it will cost them money too, if they do not turn up you win by default (has happened several times), if they defend the action it cost them in case prep and legal fees, you still may win but you can lose too.

    All good fun and a lot more productive than beetching to some committee or whatever that is not fit for purpose.
