    pappa golf that is not correct in the case of PCS sending a Notice to Keeper or NTO. Yes they are a debt collector but they do the back office stuff for quite a few small PPCs; they get the DVLA data for them and issue the NTK.

    So, this is 'appeal time' for the OP.

    Lauren, just use the template first appeal which already asks a shedload of questions as you will see (it's the longer appeal in post #1 of the NEWBIES thread, the one for IPC members).

  • Hi All,

    I've written on here before about this parking fine. I have ignored it and now I am slightly worried.

    I have had a letter through stating that they will commence legal action within 14 days if I do not pay £150. The area was a car park which is permit only and I do have a permit. I have kept my old permit and my new one. I presume they gave me a ticket because my permit fell off the shelf or for some reason wasn't fully visible but I can't remember as it was back in December last year.


    Any advice?

    A Gladstones letter? Or one from the parking firm?

    Just search the forum for similar ones, so keywords for the search box above the threads on page one of this board: 'Gladstones letter' if this is them. Responses to every type of letter will have been covered on threads every week, just waiting for you to read them and copy what others have done. It's better to find similar threads and the advice already given several times, than to wait for single answers on one isolated thread. So, have you searched & found similar threads on here or on pepipoo, always worth a good look:

    I have been on the Law Society's page and found their info. Their address is: 1 The Stables,
    Red Cow Yard,
    Knutsford,
    Cheshire,
    WA16 6DG,
    England

    Although on my letter it is: The Terrace, High Legh Park Gold Club, Warrington Road, Knutsford, Cheshire, WA16 6AA

    I have read so many posts and threads but don't feel like I am getting anywhere with it.

    You will if you narrow it down, and you will find out far LESS if you wait for odd snippets on this little thread.

    Narrow down your search to 'Gladstones Letter before Claim' or 'Gladstones LBCCC'. Or on pepipoo forum, just put in one word 'Gladstones'. You will find loads but only read the threads that are at LBCCC stage, like yours. Do not read any old thing about actual court defences etc, you are not there (yet) but will no doubt need a defence a bit later.

    Use the address on the letter.

    Gladstones moved offices officially on the 1st September so are no longer 'Red Cow Gang'

    You will need to do a formal response, however be warned Gladstone's typically ignore such responses and will issue proceedings or even attempted to add another fake £50 to any response as they have done in the past.

    Please show us your proposed response based upon other similar threads. Don't spend ages on it and do not give away who was driving, assuming you have NOT, so far.

    And don't reply by private message (pm) if you are sent a 'pm' by any poster with less than 1000 posts, offering to 'help'. You never know who they are and we do not do this off-forum, not now and not at defence stage.

    No you never do know who they are - however from threads on the forum, not so long ago Coupon-mad was suggesting NEWBIE posters with court claims should 'help' each other via private message.

    However, I am sure quality counts more than quantity for Coupon-mad's self imposed criteria for responding to pms on the forum. Trouble is there are many other 'trusted' posters who do not meet the magic 1,000 posts.
  • From looking at this forum, I have come across this letter - opinions? Would you add anything? Take anything out? I have kept my old parking permit (not mine but it is a visitor parking permit alongside the new parking permit as evidence that I park there frequently and have never had any bother before or after this fine).

    I note your Letter Before Claim dated 1st September 2016.

    I deny any debt to your client. I will not be telephoning you but require further information in writing.

    The driver is not identified in your letter and you have written to me as the registered keeper. I am not liable because I do not believe that your client invoked Schedule 4 of the POFA 2012 with fully compliant documents.

    You cannot presume that I am in possession of all the documents referred to in your letter and I require a copy of the Notice to Driver and Notice to Keeper to inspect so that I can make an informed decision. Please send copies of these and any documents that will be produced in the event of your threatened action, including copies of all photographs taken and evidence of the contract itself (clear evidence of the terms on the signs at the time).

    I also require evidence of the contravention. If the driver is alleged not to have had a parking permit, I cannot be expected to know or answer to that allegation as keeper of the car. However, the burden remains with your client to produce evidence and I require that now (e.g. photographs of the driver leaving the site, if that is the allegation).

    In order to understand my legal position, I also require the following information:

    1. Is your client's intended action funded on a contractual charge, a breach of a contract or trespass?
    2. What is the basis of the £150 charge?
    3 If it is for legal services, has your client already paid it?

    When I receive the documents and your answers I will be in a position to make a more detailed response and as such, it would be wholly unreasonable and vexatious to proceed in the small claims track at the present time.
