As posted, it doesn't matter about the blue badge, but was there a disabled person involved on all these occasions?

You may be able to use this as part of your defence (see #9)

THE REGISTERED KEEPER and the BLUE BADGE is again the REGISTERED KEEPER! (mother)
The blue badge was not used by anyone illegally just wondering if it could be used to benefit the case at all!

Definitely not, if she wasn't in the car as a passenger or driver on these occasions. Yes if she TRUTHFULLY was. Never lie in court forms!

She can use the POFA 2012 Schedule 4* though as one of her defence points because she wasn't the driver. UKPC signs are pale, unlit, sporadically placed and unclear and do not adequately warn of the £100 charge, which is a requirement of that Schedule in the Act. And their Notice to Keepers do not meet all the requirements of paragraph 8 of Schedule 4 (you don't need to say exactly why, at initial defence stage).

Is this a permit car park and was each PCN for not displaying a permit? Why did the driver not display a permit, had it expired or did they not have one, were they a visitor there and didn't realise or did they live there?

Tell us a bit of background when you post up your draft defence here.

    * that Schedule is dead easy to read and is linked in the NEWBIES thread post #1.

    :)

The "driver" is irrelevant. (And is hopefully unknown to the Claimant or Court)

The claim form should be dealt with by the defendant named on the claim.

You contest jurisdiction if you feel your case should not be dealt with by the court.

Assuming you are happy for your case to be dealt with by the County Court no need to worry about this.

The important section to tick is section 1 (Confirming you are defending all of the claim)

you need to get this word "driver" out of your head and assign the correct names to the people dealing with this

the person named on the paperwork is the defendant in this court claim so any queries about it should be exactly that and no other name, you have already confused us all with strange titles and strange names, time to get it straight in your head so when you ask a question the question gets answered because you have given the correct details

this is no longer about the "driver", probably never was , so no the driver should not be doing anything you have asked already, because the paperwork went to the registered keeper and she does not drive as you said so yourself

    Initial request to the claimant

You need to read up on all this so you know what you are doing!

This EXACT question is already covered in Bargepole's advice in one of the links in the NEWBIES thread under 'small claims'.

And an example of a Part 18 request is already there for you to see in the BMPA link already posted in Garsantinos' thread.

You do need to read (and re-read) everything/every link we've already advised you to read.
