Thank you
I cant find "the latter third of post #1 of the NEWBIES STICKY THREAD" i found the skeleton defence by baregepole0 -
I know seems very hopeless now but thank you fisher0

In your other thread you said this wasn't in your name? Whose claim is it?
You said you only have 8 days - why? What date did you get this paperwork?
The person to whom it is addressed is the defendant and MUST acknowledge the claim (have they done that already within 14 days of the court papers being served?). If they do that and leave the defence box BLANK, they then have 14 days to work on a defence which follows. This will involve reasearch and work by the defendant. But that's better than coughing up a 4 figure sum!
You should read the NEWBIES thread links about small claims. The NEWBIES thread is near the top of this forum so please:
click one click back to page one on the breasdcrumb trail (top of this page, small blue writing, click on 'parking tickets, Fines & Parking' which gets you one step back 'home' to page one). THEN read 'NEWBIES READ THESE FAQS FIRST' looking specifically at the advice about SMALL CLAIMS. The links are there for people like you.
And then start searching this forum for 'UKPC Court' to read other threads just like yours where the posters are already ahead of you and you can learn from them. Here's one but there are a fair few, so do the forum search!

Has the person acknowledged it yet and who is the person/defendant of not you? YOU CANNOT DEFEND IT IF YOU ARE NOT NAMED ON THE COURT PAPERS.

in your other thread you said this wasn't in your name? Whose claim is it?
It is in my mothers name she is the named driver thats all..
You said you only have 8 days - why? What date did you get this paperwork?
I got the paper work on the 4th of this month ..
if you have anymore advice Id really appricate your help!0 -
then your mother has to defend it, so dont tell us you have received court papers when its actually another person
that KEEPER (the person named on the court papers) needs to follow the court claim advice in the bottom third of that NEWBIES sticky thread, and she must do EXACTLY as coupon-mad has said above
sounds to me as if its a vehicle registered in her name, so she would be the RK, possibly not the driver though,0 -
I wasn't trying to missleed. She is the registered drivre and no she didnt drive..
I will produce a defence and see what you think0 -
Registered Keeper? There's no such thing as a registered driver.
Your mum was registered keeper of the vehicle (e.g. the V5 is in her name), and someone else was driving at the time? (Yes or no, DON'T say on here who was driving).
What are the EXACT particulars of claim on the claim form (word for word) and what exactly happened, and when? Refer to the driver as 'the driver'.Je Suis Cecil.0 -
Have you read other threads yet, found the really recent threads by Garsantinos and Anthony94? Have a look (NO LINKS GIVEN, SEARCH!).
Send them a private message and compare notes. It will help all three of you.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

My next actions.. please correct me if im wrong!
1. Online Acknowledgement. ( MoneyClaimOnline) - Without anthing in the defense box!
2. Part 18 Request - Im a bit unsure of what to ask ? what additional information?
3. First defence ( again unsure as of right now what my defence could be).
If there is anything else anyone could advice on let me know ty0 -
Part 18 Request - Im a bit unsure of what to ask ? what additional information?
First defence ( again unsure as of right now what my defence could be).
Both are already covered in the links and threads we've mentioned for you to read. For example in the other UKPC Court threads I've directed you to, by Garsantinos and Anthony94 and dansim17, they are ALL working on their Part 18 requests and defences, having read the links they have been given.
As well as reading the NEWBIES sticky thread links about Small Claims, also then go and read their threads (those three, and I will not link them, you need to use the forum to find things & search or you will miss stuff). Read the answers they have been given as if the answers and links were for YOU. If you are still struggling, I have already said send them a pm to compare notes. There really is no need for us to reply individually to four current threads about the same thing.
And why are you calling it 'my defence'? It is your mother's defence. YOU CANNOT RESPOND TO COURT PAPERS IN HER NAME.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
