Question for NP with experience of litigation, whether as client or lawyer:
Solicitor A is acting for client B, suing defendant C for expenses that B has incurred because of an incident that was C's fault. C has admitted liability, and C's insurers have paid up for B's initial expenses, but are dragging their feet about paying for B's ongoing costs. Should B expect to have to hassle A to keep on at C's insurers' solicitors in order to get any money any time soon? Is that just "one of those things"? Or should A be more proactive than that on B's behalf?
Eventually, the costs mount up until B is running out of money and is going to have to borrow to meet those ongoing costs unless there's some cash from C's insurers soon. Suppose A is saying that nothing can be done about pushing for payment until more evidence has been obtained, which is going to take a while. A starts investigating how to get the extra evidence. Meanwhile, B talks informally to a friend of a friend - another solicitor, D, whose practice deals with cases of a similar kind. D says that this extra evidence should indeed be obtained, but that A should be pushing C's insurers for money immediately, while the extra evidence is still being sorted out. What should B do next?Do you know anyone who's bereaved? This is true, unless the solicitor is generally a waste of space, although this situation is rare.
Asking A to get B to chase C's insurers if it's worth doing (as in the cost is going to be outweighed by the potential).
Issuing a joint court claim against C and C's insurers is possibly going to get their backsides into gear, especially as they've already admitted fault. Sadly, even if a judgement is obtained, it may take HCEOs to actually get money. It may be quicker to go down the 'playing it nice' route, but if they're already dragging their heels maybe not.
