Parking charge in my own space by UK Car Park Management Ltd

Apologies if i am doing this wrong - i have not used this website before

I received a parking charge from UK Car Park Management Ltd on a car parked in my own space. This space is mine and came with the flat that i bought. The parking scheme was brought in after i bought the flat and therefore i don't see that i have any contract with this parking company and nor requirement to display a parking permit.

I appealed to the IAS and they dismissed my appeal (it seems this is not unusual) and now they are threatening court action. Am i right to stand my ground and are they likely to take me to court over £100? (£145 now with the court charges)

    I have looked through the newbies thread and couldn't immediately see anything relating to this

    I have looked in my flat lease and there is nothing about a parking scheme

    Does this threat take the form of a proper "letter before court action" from them?


    If so they are highly likely to progress to court action.

    It says that if i don't pay the £145 they will forward the case, including the IAS dismissal, to the county court bulk centre

    Is it from UKCPM Ltd? Can you post more of its contents. (Without revealing anything about you/your "offence")


    Doesn't sound right (as they are asking you to pay "court charges" when non have been incurred yet)

    I will post the relevant contents of the letter when i get home later.
    If they are asking me to pay court charges it implies that they have started the ball rolling?

    All very concerning. I am willing to go to court as I honestly don't believe i should have to pay for parking in a space that I own.

    OK. We'll assume it's a genuine letter before action, though had they already paid for a claim you would have heard from the Court.


    But if you are happy to see them in court just get on with preparing your defence now so that you don't feel rushed if the claim is on its way.

    I am becoming a bit of a bore on this point, but do look at your lease to see if there is a "catch all" paragraph or section that permits the managing agent or land owner bring in unspecified measures for smooth running of the estate, such as the OP has identified in the first post here https://forums.moneysavingexpert.com/discussion/5409198

    The 3 sections you need to read in conjunction are

    1. Parking clauses
    2. Peaceful enjoyment without hindrance clauses.
    3. The catch all clause.

    Any court case would hinge on all 3.

    the catch all will be something along the lines of the management company will take reasonable measures to ensure the smoothe running of the estate/land/area
    From the Plain Language Commission:
