    Sounds like an LPC helper. He may not be a solicitor and on the Solictors Roll but he should be under the supervision of one. Ask which one.

  • I lost ....
    The judge was a complete !!! about it and rejected my defense that I used which was similar to the one seen in the recent parking prankster ukpc post.
    Now I have to pay £610 :(. One ticket was removed.
    £120 per ticket and 60 pound +70 pound fees.
    I said it was a trespass case and not a contractual one and he wasn't having any of it. He kept saying you didn't bother getting out of your car and reading the signs so you are liable.
    At the end he added, let it be a lesson.
    I was like what???? This is definitely a punishment.

    I was also dismissed from work today because my boss wasn't happy about me taking a day off for court.

    If a few grand does not mean much to you, It might be worth seeking legal advice. When my wife was arrested for alleged shop lifting I took it to the Crown court, the CPS chickened and paid my £10,000 legal bill. I would have gone after Tesco as well, but my wife was not up for the fight.
    You never know how far you can go until you go too far.

    In regards to the judgement. It felt like the judge himself had no idea about any of the laws related to parking fines.

    At first he agreed that it was a prohibitive sign (trespass) then he changed his mind and said it was contractual because I entered the car park.

    Then he started rejecting all the other points such as the charge being disproportionate to the crime.

    He said that he thought £150 reduced to £120 each ticket was reasonable and was not a punishment. Clearly judges are being paid way too much.

    Sorry to hear this.

    Regarding employment ... everyone is on a 2 year probation anyway, irrespective of whether it is formally termed that way. Within the first 2 years an employer can dismiss anyone for any reason they like (as long as it's not related to something protected in law, like racial, religious or or disability discrimination).

    So sorry to hear this, Garsantinos.

    It was worth the fight but the Judge sounds just like the one on pepipoo that Joe_R was up against this week. You are not alone. Lots of cases are still lost (got to be honest) and not all cases get to be reported on the Prankster's Blog. Often it seems to be that a Judge has set opinions against the consumer from the start and/or is easily swayed by the smooth talk of the other side's rep.

    It can be worth a try but you'd need to look into the cost and you'd need to have reasons why you could show the Judge erred or failed to consider a particular issue, to get it re-heard on that issue. e.g. the prohibitive signs, no contract offered, Judge at first agreed with you and failed to reason why and how he then did a U turn and decided that a contract was offered by prohibitive signs.
