Company contacted me 6 months after purchase stating failed to collect PayPal fees

  • The exchange rate for the Euro on the 1st August last year was 1.42 to the £ and today it is showing as 1.29 to the £.

    This means that if you pay the €292 now it will cost you about £229 but in August it would only have been £208. The Paypal rates will probably be different but you will still end up losing more than £20 extra because of their failure to collect payment.

    I would pay them their £208 and tell them they need to review their accounting procedure and customer service. Tell them you will send payment in 7 days.
  • I wouldn't do anything by their arbitrary timescale. This is much the same situation as if he had sent them a cheque and they destroyed it, then contacted him six months down the line and threatened him with court action unless he sent another in seven days - while admitting that they had destroyed the original six months ago without telling him. It's an absurd position for them to take.

    To be honest I'd be tempted to just reply that I acknowledge that the money is still owed due to their error, but I will pay within six months at my convenience, and see what their lawyers make of that.

I wasn't sure whether they counted as a 'creditor' and could therefore claim the fee up to 6 years later?

    Any insight would be appreciated!

    Surely you should have an extra £200 in your Paypal account and it should still be there if you didn't realise it hadn't processed? If it returned to your bank account didn't you think that an extra £200 might be a bank mistake of some sort and query the bank about it?

    I'd like to see exactly what the company said.

    And also whether the company actively markets to the UK. Because if they don't, they'd have been well within their rights to send the message in German.

    It doesn't seem like the company were being intentionally rude and didn't set out to offend they just want what you owe them. Why are some people intent on being pig headed because they don't get the hearts and flowers approach they seem to think they deserve.. I seems like someone is p***ed they have been caught out while trying to keep their head down to get a freebie... Pay the bill, you owe it and trying to throw a strop won't do you any favours.
  • What a lot of nonsense.

    They failed to collect the payment which he sent. Then they waited SIX MONTHS, then threatened him with court action instead of apologising.

    If I am in a shop and go to pay, they say to me "That will be £5 please,"

    If they say "That's £5, pay up or I'll have you arrested for theft." I will tell them to **** off, leave the item and walk out. Then they will be more polite to the next person.

    The company needs to apologise and amend its procedures. If he just pays up, it won't.

    He only owes them money because of their stupidity. They didn't notice for six months they had failed to collect a payment. Then they threatened further action and set him deadlines instead of saying sorry, we've messed up, can you send payment please.
