How long did you have the hire car for? I have an Albany assistance hire car at the moment and it says costs are £25 per day. Surely you didn't need it for the best part of a year.

I'm confused why your insurance hasn't covered it, did you and the other car share the same insurers?

You must be in a very very small car for that rate to apply,
  • My car was a 3 litre BMW & they offered me a Mercedez as a like for like. I had the car for a month

Seems to me like Albany dont care where they get paid from, so long as someone foots the bill there happy, not really fighting for their client as you want your solicitors to do. Now your attending court I hope all the threat of debt collectors etc. is removed. Somethings very wrong when major insurers are recommending Albany and their like.

When you agree to let Albany handle a claim then your insurer is out of the picture and covers nothing!
  • Surely it's not that simple legally for Admiral to not help in anyway as I am their "valued" customer so I keep being told. I have had no warning letters prior to the one received from Albany stating that they are holding me accountable for the charges due to failing to co-operate which I was at the same time told by their solicitors that the signed statement will only be required if this is the case as these claims usually get dealt with before they get to court. Albany can use any excuse to say down one is not co-operating but where do we draw a line regarding what there reasons for making such allegations are

Did the letter asking for your bank statements not remind you of your obligation to help them?

You cannot expect Admiral to intervene on your behalf over your (alleged) breach.

The line is "drawn" by the wording of the contract between you and Albany. If push comes to shove, then that wording will be your main hope!
  • Thanks for the advice. Will hopefully get some positive response tomorrow & will post the response from them
  • In further response from above post- The letter I received regarding bank statements had no mention of my obligation to help them. The communication has been poor throughout & there was no warning letter etc prior to the one recieved yesterday stating that I am now liable etc

When you received the letter, you no doubt contacted them to question why they want the bank statements. Everyone does this or posts on a forum asking why they would want this.

Did they not explain to you when you contacted them that this may be needed for court and remind you of your obligation to assist.

Or did you happily try to arrange the statements without asking them about it?
