  • Dear all, The court date is only a matter of days always & I have cancelled my work & will be left open to disciplinary action however that is the last thing on my mind. I have emailed the solicitor & Albany advising them that I will now be attending court & will hope to get a response from them tomorrow as it'll be a Monday. If u go to court & Albany fail to be reimbursed by the other insurer can they still say that I am being co-operative? Thank you

    Have you been through the stage where Albany asked for you to supply copies of your bank / credit card statements.

    If so did you supply them?
  • I was asked by the solicitor for bank statements etc but explained that I do not keep old statements. I have requested a letter from the bank to confirm that I was not able to afford a replacement vehicle during the period in question. It was a like for like vehicle as that's what was offered to me. I'm hoping I receive the letter as I did not receive this after 2 attempts & as the court date is nearing I hope to finally recive it so it can be presented in court.

    Could you have not obtained print outs of your statements via online banking or paid the bank to supply them?

    Have you shown your employer the paperwork? If they still refuse, you may be able to get a witness summons if there is time. Either way, you shouldn't be open to disciplinary action and should be able to claim travel costs and loss of earnings. It'll be explained in the court paperwork.

    The branch should be able to do a printout for free. Doesn't need a letter...

    How long did you have the hire car for? I have an Albany assistance hire car at the moment and it says costs are £25 per day. Surely you didn't need it for the best part of a year.

    I'm confused why your insurance hasn't covered it, did you and the other car share the same insurers?
  • I have shown my employer my paperwork but at the moment the stress of this whole situation has put that at the back of my mind until this is sorted. I've emailed the solicitor today hope to speak with them tomorrow. My main concern is that Albanys letter was dated the same day that I spoke to the solicitor explaining that I have recieved & returned the court statement & he stated that was fine & to return it to him. Albanys letter dated on the same day says that they have removed the indemnity on the policy immediately for failing to co-operate & that Helphire who supplied the car will be sending me an invoice for £6k+. But the case isn't due to go to court for another 4 days & after speaking with someone at Albany yesterday who worked in a different department they let it slip that the case will be sent to a debt collector a day after it is scheduled to go to court. Is this their safety net as if they don't get the money from the insurer they will come after me & say that I wasn't co-operating etc when I have now changed everything & now attending court..please advise, many thank you

    As advised in your other thread (why 2??), Albany may have already cancelled the court hearing in order to save the costs (after you refused to co-operate) which they will have paid for the hearing (the claimant can get a refund of the hearing costs if they cancel the hearing and give at least 7 days notice)


    ie your change of mind may have come too late!
