Here she needs to report and claim on her insurance for the total loss of her vehicle-period. If they refuse to deal then she needs to report to the Insurance Ombudsman who I think will force insurer to pay out. In effect she’s claiming the loss of the car in the same way as she would if it had been hit by a tree, bin wagon, meteorite. Of course if she’s only TP or TPFT then she has an issue. If fully comp then game on.
If TPFT or TP then she needs to sue to recover her losses. Small claims limit for issues with no PI element is £25k so she’s effectively encouraged to take the other side to court herself or pay for her own legal representatives at the local county court.
She could continue to claim for loss of use of the vehicle on a daily rate (approx. £15-£20 per day or such sum as a court awards (you’d aim high) together with ongoing travel costs.
If council are offering money she should work out a pre-accident value of her car by reference to local papers, auto trader etc and present evidence of her claim marking any communication ‘without prejudice’. Allows her to change figure moderately if she has to continue with claim for any further time where expenses increase.
Not one I can get involved in but an email or recorded delivery letter (this is the TP/TPFT scenario) stating;
Value for her vehicle (backed up by independent articles)
List of travel expenses to date (provide copy receipts
Continuing loss of use at £20 per day (no mention of car type, generally prestige = higher daily rate etc)
If she receives an unsatisfactory response or no response then she should go to the local county court and try a and issue.
If she doesn’t fancy this route then if she has a relationship with local councillor then may intervene on her behalf.
Whilst she’s there she could mention the Small Claims Limit. This used to be £500 years ago and if it was still that figure I could have done a letter of claim within the hour and issued formal court proceedings in the next two weeks. She’d have to pay no legal fees and I’d run it start to finish an batter them!! Imagine having to run a PI claim yourself for £5k?0 -
You are being too patient.
Councils are notoriously slow to act.
But you look to be sitting on this and just giving weekly updates here.
What happened about getting the local press on the story?
You need to be making more noise about this locally at the council office/ councillor/press.
The ombudsman won't get involved till you have exhausted the complaints procedure at the council and then will take months to give a final response. You need action now.0 -

1: Your conservative MP. They have clinics so make an appointment and take all the paperwork to him/her

She had a fully comprehensive policy but the insurance have already stated they will not cover her because it was not a motoring claim. This is a civil matter.0
