You will only get a CCJ on your record if you lose in court and don't pay up in full within 30 days. (So don't just pay up cos your scared of having a ccj at 21!)

No not strictly true either - as default judgments apply if for example you have either not acknowledged the claim within 14 days (from service) or you fail to either submit a defence within 14 or 28 days (from service) and then also fail to pay the CCJ.

So saying if you 'lose in court' implies a court hearing

The claim form should state "Particulars of Claim" on the front of NICPC claim form. (Bottom half of the front page - largest section, directly under your name)

As the initial period allowed for the defendant to disagree with the claim and send in a defence is 14 days, then claimants don't get 14 days after the claim is issued to then send the !particulars of claim".

If the form you have received is blank in that section (particulars of Claim) then it could be a "fake" frightener sent by the PPC and not a court claim at all! (Or omitted in error by the Court)

If you are certain it is from the Court, and the section "particulars of claim" is blank then all you need to do is write and report this to the court and explain you cannot submit a defence as you don't know what the claim is about.

No these court claims are genuine and full POCs are arriving within 14 days of service of the claim.

these are ploys I believe to get quick payments.

@ Sweeterman - who has signed off the court claim ?

Michael Schwartz or Ashley Cohen as he is also doing the rounds again.

You really need to ensure that you have acknowledged the claim and I do hope that you did not mess this up by putting something in the defence box the first time?

YOu will have needed to create an account with email and separate password.

I would suggest that you phone the court or email them to state you cannot log back into acknowledge the claim.

It says that I would be supplied with the PoF within 14 days of the CC form. All it says is outstanding debt and damages.

And a total inc court and solicitor fee.
    I guess you mean "PoC"

They have provided you some PoC

They are allowed to supply detailed particulars later on - the way the on line system works only a limited number of characters are allowed.

Though you do know from the PoC supplied what this is all about!

So don't try and get it all done in a day.

Send your acknowledgement in by post (get a proof of posting from a post office), and give yourself 3 weeks+ to get your defence together then come back with the draft instead of continually relying on one topic at a time like this.

    Why be so pedantic?

The OP was saying he didn't wanna get a ccj as he was only 21, and my reply was intended to put his mind at rest that a CCJ will only affect him if he ignores it after getting one.

    But you know that.
  • Yes I know that if I don't acknowledge it and ignore it chances are I will get a CCJ.

No I did not submit anything , I signed up and then used the Claim number and password on the CC form to check if it was a genuine claim.

It is a Michael Schwartz name that Has been printed at the bottom of this claim.

I have been reading through some threads and what to do... But because I wrote to them admitting to it and also saying I didn't take notice of the signs, I can't really see what I can build a defence on (I still have no idea what to do even after reading through bits for the past couple of days)

    Starting a claim
5.1 A claimant may request the issue of a claim form by–
    (1) completing and sending an online claim form; and
    (2) electronically paying the appropriate issue fee,
via Her Majesty’s Courts and Tribunals Service website.
5.2 Detailed particulars of claim must either be –
    (1) included in the online claim form but must be limited in size to not more than 1080 characters (including spaces); or
    (2) served and filed by the claimant separately from the claim form in accordance with paragraph 6 but the claimant must –
    (a) state that detailed particulars of claim will follow; and
    (b) include a brief summary of the claim,
in the online claim form in the section headed ‘particulars of claim’.

why is the online option playing up , does it not like your details?

It usually works fine but the passwords are very easy to misread as the use characters such as 0oO which it's easy to convince yourself are the wrong one of three.

I'll go for Schwartz as he was on another i saw.
  • I logged in with the correct information otherwise i would not have seen the claim online which i have already viewed.

I wrote down my log in information and now it seems to think either my user id or password is incorrect but it is definitely not.

I also tried to re register to view the claim but maybe because i have accessed it already it says it is incorrect claim number or password.

You need to contact the court by phone then to ensure they know you are acknowledging it & find out what to do to ensure you don't fall at this first hurdle. Read the paperwork, there must be a paper option?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
