I would not say anyone is 'stuffed' against CEL because they are not court hot-shots by any means. CEL may not turn up & may drop out before a hearing, going on past performance (BUT you MUST turn up if you get a hearing date, even if CEL email or phone to tell you they won't be, you have to or you'd lose - and they know that).
A decent defence showing how your case differs substantially from the Beavis case (listing the usual defence points you will find on other threads) is worth submitting to show them you are not a pushover.
Not sure why MoneyClaim says the information is wrong. Is it letting you acknowledge the claim?
I'm assuming you've not yet acknowledged it. If you can acknowledge it then leave the defence box TOTALLY BLANK, not even 'TBA' in there. That then gives you extended time to submit a defence.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Of course If it goes to court I will show..
And yes I did think this at it isn't a overstay at a free carpark (if that's what the beavis case was?)
And no I haven't acknowledged it , I only logged in to see if it was a legit claim. But now I logged up I can't seem to get back into it!
So I can just acknowledge the claim and leave it , that will then give me an extra 14 days to submit a defence sheet or just pay the fee?0 -

Yes. See#2!!0 -
Have you actually got the particulars of claim ? CEL usually say they'll be sent within 14 days of the claim form.0

No haven't received particulars yet... As I only received the court claim on Saturday morning.
Because I said in my letter I was waiting and that I appreciate terms and condition but didn't read signs... Valid points for a defence against that is what I'm not sure about. I will be reading though more threads when I'm home from work.0 -

.
As the initial period allowed for the defendant to disagree with the claim and send in a defence is 14 days, then claimants don't get 14 days after the claim is issued to then send the !particulars of claim".
If the form you have received is blank in that section (particulars of Claim) then it could be a "fake" frightener sent by the PPC and not a court claim at all! (Or omitted in error by the Court)
If you are certain it is from the Court, and the section "particulars of claim" is blank then all you need to do is write and report this to the court and explain you cannot submit a defence as you don't know what the claim is about.0 -

If the online option is playing up, isn't there an option to acknowledge by post?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yes i am reading through the bpa cop and there are points in which I think I could note down to be investigated.. But I don't think it looks good if my skeleton defence is just full of numbers of points in the cop.
And yes it may seem as I'm asking for too much help but I'm useless in these things!
Let's be honest it's just easier to pay the £255 but I'm not planning of just giving it to these idiots.
If its any consolation I had "no idea" a few months back, but I have now beaten off CEL with 2 court claims and several POPLA appeals (with the help of the regulars on here). Believe me it is so satisfying.
You have to be prepared to put the work in though - you will learn so much and you kind of get hooked.0 -
The MCOL says that the passcode I entered is incorrect but it is not... I've already viewed it once just to see if it was legitimate and it is.
It says that I would be supplied with the PoF within 14 days of the CC form. All it says is outstanding debt and damages.
And a total inc court and solicitor fee.
After viewing some threads of people being told 'they shouldn't have overstayed a time limi or 'should have payed for longer then you thought you were going to stay'. Aren't I going to be told I should not have waited inside a controlled car park?
