And did anybody say that the ombudsman could hold a customer to account?
A ombudsman can award any compensation it sees fit for any circumstance including as asked by either party of the dispute or of its own accord in a ruling.
I am verifying to the OP the ombudsman cannot hold them to account for Voda contractual failure to collect the monthly bill via a preauthorised but uncollected DD, not to be afraid to challenge Voda via Ofcom or Ombudsman as the failure of payment collection will never be looked at as their failure but Vodafone's.SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe0 -
No they had a legal right and obligation to collect payment and failed, to the other parties detriment, so of course Voda should apologise, set up a payment plan for the arrears they caused and compensate the customer for their incompetence in actually failing their contractual obligation to collect monthly payment under a customer authorised and Vodafone approved process.
That really is complete nonsense. No detriment, no cause to compensate. The customer owes the money and had the benefit for the period it wasn't collected. If it had been collected they wouldn't have had their "emergency savings" in the first place. It also beggars belief they didn't notice payments weren't being taken.0 -
So you haven't looked at your bank statement in 5 months, have effectively had an interest free loan for the same period, and now expect Voda to compensate you for that?No free lunch, and no free laptop0

Customer shall pay all invoices by the Due Date without set off, unless validly disputed in accordance with clause 6.3 below.

6.4 Where Vodafone has not received payment for undisputed Charges by the Due Date, Vodafone shall:
(a) contact Customer’s accounts payable department (or other contact advised to Vodafone in writing) to request payment;
(b) be entitled to charge interest on the overdue undisputed Charges at 4% per annum above the base rate of the Bank of England; and (c) be entitled to charge Customer reasonable administration costs as a result of Customer paying late. Customer must pay its Charges by direct debit.
Where Vodafone has not received payment within 5 calendar days of the Due Date, Vodafone shall contact Customer again to request payment and give notice of the actions Vodafone will take under clause 6.5 if payment is not received.
6.5 Where Vodafone has not received payment within 5 calendar days of the Due Date, Vodafone may take all or any of the following actions until such time as payment, including any interest due, has been received:
(a) withhold any sums owing to Customer by Vodafone (including Subsidy); (b) suspend Customer’s and/or User’s use of the Services in relation to which Charges are outstanding; and (c) subject to Vodafone having taken one of the actions above, issue a notice under clause 10.4.0 -
