    We saw the signs on moving her in and rang the letting agent immediately - they claimed they said they had never been asked before and not to worry about it.

    We also spoke to the landlord who said he knew nothing about the need for a permit.

    There is no mention of parking or permits in the letting agreement.

    It is a car park solely for use by the apartments and the apartment numbers are painted in the bays.

    There would not be if the landlord knew nothing about it. Get him to tackle the MA as the PPC are harassing his tenants.
    You never know how far you can go until you go too far.

    Tell the letting agent that you will be deducting any charges from the rent as it is their error. (I am assuming you pay the agent and that your letting contract is with them)

    Quick update....

    We've received a reply to the 1st appeal - as expected it is turning down the appeal and quoting that they will go to court etc

    However, they have not supplied a POPLA number and have asked that we send them a copy of her valid permit (which we now have). If we don't, they say will then provide us with the POPLA No.

    Is this a ploy of some sort (I don't trust these people at all!) and I should just go down the POPLA route? Or do we have nothing to lose in sending them a copy?

    if they want proof and you have that proof I dont see any problem in providing a copy of that proof (but not the original)

    they may cancel the ticket after receiving the proof, if not then you get a popla code and take it to popla

    so seems a reasonable request to me

    This is a standard stalling tactics letter, they also use another similar one, fishing for the driver's name. Hope you didn't imply who was driving when you rushed to reply to a letter/email you could have ignored. Bit late to ask if it's a ploy of you've replied already. You don't have to jump when UKPC say jump!

    UKPC would have sent the POPLA code anyway (should have asked us first but no harm done as long as the driver hasn't been given away).

    I haven't replied as yet (not sure what makes you think I had? Maybe saying 'Which we now have'? What I meant by this is that we now have a permit.)

    I left it 26 days before appealing and am asking if it's worth sending them a copy of the permit they have requested or not.

    I have not and will not be giving them the drivers name.

    Have you any idea when the tenancy was vacated prior to your daughter renting the property and does the landlord always use the same letting agent ?
    I find it hard to believe that the Landlord and letting agency where totally unaware that a parking permit was required, unless it is a very recent occurrence and people who should be 'in the know' have not been notified. It sounds like a case of the tail wagging the dog - the management company need to be put in their place and made to realise whose paying their wages.

    They are saying that their only responsible was for finding the tenant and that any issues with the property etc must go through the landlord.

    The landlord isn't local and is apparently unaware of the need for parking permits.

    Out of interest, what benefit would UKPC get out of stalling for time by requesting additional information?

    They are hoping you will give away the driver's details, save them the DVLA fee to find out the keeper's details, and throw away a valuable appeal point.
