LPS threaten me to tow my car away?

    however the land owner can remove or pay a company to move it off their property .


    the part about selling your car is illegal at first glance

  • How do we know that if they have contract with the landowner to move it off their property?

    I am sure that they are not in contract with the landowner so the PPC can't tell me what to do or make me to move it.

    you have not told us as to why the car is parked there ....;)

    but if its on some one else's land then it might be easier to move it than to have to fight parking tickets ........

    It is probably unwise to argue the legalities in terms of whether LPS does or doesn't have the landowner's authority to remove the vehicle - they clearly believe they do and given that I would hazard a guess that they are likely to remove it regardless.

    Going back several years ago a gentleman discovered that even though NCP (as in the car parks) and their agent did not have the legal right to remove his vehicle they still did it and it took months and an expensive legal battle to get it back. Ultimately, NCP and their agent had to stump up the cost of the proceedings but only when ordered by the court to do so.

    So, @ OP Two questions:
    1. Do you think LPS would be able to pay for a prolonged legal battle?
    2. Even so, do you have the wherewithal to (legally) fight to get your vehicle back?

    If the answer to either of the above questions is "No" then I'd suggest that discretion might just be the better part of valour.
    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    @Coupon-mad Well it wasn't from the landowner who employed the private car park company, it was from the committee so I have been told they are not on the contract and the landowner didn't say anything about the private car park company.

    Do you recommend if I should ignore it or not?

    Do they have power to tow my car away?

    Nope, I would not ignore it, I would not park there for the reasons explained by HO87.

    A private firm cannot lawfully tow your car away, no, because the POFA 2012 makes that a criminal offence. But do you want that fight?

    Why would you choose not to ignore it? I thought it would be illegal for them to tow my car away?

    Exactly that, not legally but it wont stop them.

    Then how long to fight it and legal costs. Then you get the car back if your lucky and its in a state. All the time hoping they dont go bump and your car vanishes.
