Perhaps he thinks that now he's no longer living at the house he no longer has to pay childcare....
He's wrong.
Regardless of the circumstances of the split, he's still liable to pay maintenance for his children.
Maintenance yes, childcare, no.
He is not required to pay for childcare unless there is a court order requiring him to do so.0 -
Thank you for all your help. I'm really appreciative of you all spending your time to post.
Just to clarify on a few posts. He was blackmailing her with a second account by holding the current one open which he would deduct from her childcare, whilst she also would have to pay for a second because he wouldn't transfer the account over and told her he couldn't cancel it and hence paying two lots of bills.
She has a 15 year old daughter and a 2 year old son. The 2 year old she shares with him but the daughter is from a past relationship. The house is in her name, as she owned a home before she met him and used the money from that towards the new home they both shared. They haven't been living there that long and a solicitor has already confirmed he is entitled to nothing from it due to its negative equity.
She is receiving more money than what she would through CSA, due to as someone above has mentioned that you don't get childcare costs included and she works full time.
In regards to why she kicked him out as a few I see have been blunt towards the fact she has. He has cheated on her several times, treats her like dirt, lost his job through fraud and is constantly playing mind games with her. He's currently working on a temporary basis in a new job he got just before Christmas, so she doesn't really know his salary nor situation to even consider taking him to the CSA at present.
She's coming round mine tonight so we will go through some new ISP's and find out which one is best for her.
She's spoke to him and told him of her plans, and that whatever he has done to cancel the internet he can either leave, or get undone as she will sort it herself with a different company that he has no control over, whilst also contacting the bank to ensure no direct debits come out in her name. She did state she rang BT again and spoke to a manager, who informed her that her contract had been cancelled, and one was set up in her house to start on the 23rd, but could not discuss is further because it wasn't in her name. He couldn't give her an answer as to why hers could get cancelled without her consent but yet she had no control over cancelling the new one. Bizarre situation but hopefully it should get sorted once we find a new ISP. She was just annoyed that she's had no internet since the 23rd of last month, and it was due to be setup yesterday, but got cancelled at the weekend after he'd been on the phone to them.
She also already has an EE dongle, but due to the house location it gets a poor signal and therefore speeds.
Thanks again for your replies0 -
They're married, the house is a marital asset until the court decides otherwise...0

If the internet is connected to the phone line (as ours is), there can surely only be one provider at one address, unless she gets a separate phone line put in?
It is hard to know what BT should do in circumstances like the OP's because they have two warring ex-partners phoning up and telling them different things. I presume they have to go by the account holder.sealed pot challenge 9 #0040
