You have to inform all departments of any changes. Council, DWP and Job Center. Its just the way its set up to reduce costs and make you do all the heavy lifting.

I definitely see what you are saying and its upsetting now to think I have made this mistake if this is what it has turned out to be. The biggest worry is landing in court over it if this is what the interview is about, I am totally shocked about it. I have no idea what this interview will even entail.
Would it be likely they will simply give me a chance to explain myself and apologize and offer to repay it back or will they try and prosecute me straight away? I am so worried about all of this now.0 -

Last time I checked spending £10,000 of excess welfare on mortgage debt and home improvements wasn't deprivation of capital.

The reason why I am a scaremonger is because I absolutely hate everything the Conservative Party have done since 2010 and I really do not like Ian Duncan Smith. He has contributed to the deaths of a lot of my friends.
To be honest everyone is telling you not to worry but the truth is they don't know how down right nasty the DWP can be.
You need to be prepared for whatever the DWP throw at you.
I would suggest saving some of your income into a bank account of between £2000 to £4000. Depends on how large your mortgage payments are. You need to make sure this money is put in the account which your mortgage is drawn out of. This way if you was sent to prison you would keep your home.
Now before you panic. You won't get sent to prison. No one has been sent to prison before for Pension mix up. You are also a vulnerable person so I can't see the Judge sending you to prison even if you did go to court.
And lets say you did go to court. Half the country would spot the injustice and be out on the street demanding your release. I ain't joking. People watch these things.
I encourage you to go to YourAble forum because its a much better place than MSE for disability matters.
Also read the cases on this blog and your see for a minor mix up like yours the worst you can get is a small fine.

Because I don't want you to worry I'm gonna put something on this forum which will allow a lot of people to ridicule me.
I've been done for benefit fraud before! It was almost 10 years ago and what I did was I didn't inform the Job Center that I found a job. Within a couple of months I got fired anyway. 6 months later I found 2 fraud investigators wanting to interview me. I came clean on everything and admitted my guilt. I paid back everything I owed.
And guess what?
I didn't even go to court.
Now that situation was worse than yours because I was working while getting benefits.
If you tell the truth, admit your guilt your be fine. But don't give the DWP a tunnel that leads to no where else they will just get angry about you wasting their time.0 -
Oh for gods sake " Controversy " you are scaring the bloody life out of this woman. I am a solicitor of 22 years. She isnt going to prison for this situation. At most its a small overpayment - at best its a DWP mistake.

I was automatically switched from ESA from JSA as I went to tribunal for the ESA claim as I had lodged an appeal with the Tribunal Service, which I won and was awared Work Related actvity group ESA at it. I did not fill in any forms, I was changed over automatically within 2 weeks to my knowledge.
Also, I do not claim housing benefit as I own my home.
You would need to have filled in a form to claim ESA in the first place before you had your medical. Did you put the details about your pension in your original form ?Play nice :eek: Just because I am paranoid doesn't mean they are not out to get me.:j0 -

I still am really worried about all of this.
I know i get a reduction in my council tax but don't even remember filling in the form or anything for it even if I did!
I don't even know how long this case could be backdated till.
If i have been reciving a incorrect decduction because of my pension, I don't know how long I could have gotten it for....0 -
