Did you mention the following on your Council Tax Support form and your ESA income related form?

    1. You have a mortgage.
    2. You live alone.
    3. You have a pension.

Have you been claiming housing benefit at any time since you had a mortgage?

From the information you have given I think you may have made a mistake when filling in ESA or Council Tax Support form.

Just a tip. Don't admit to anything until your 100% certain that you made a mistake because they will use it as evidence.

When your in court understand that common law does not exist anymore. The law of the sea has took over our courts. We aren't a sovereign nation in law anymore.

Treat the Judge like the Queen and glorify their Ego in the sense where you are wrong and they are right. If you show any sign of resistance your sentence will be increased.

    Blooming heck !

    It's an interview....not a court!

There is no suggestion that the OP will be going to court!

And to answer Dippy, yes I did declare it when I reclaimed and I have a letter from the DWP stating that they knew I had it and were reducing my money because of it.

If you know you have health issues that affect your cognitive ability, then you seek help from professionals of family members to complete forms. Having health issues doesn't absorb anyone from being responsible. Otherwise, you could say that they shouldn't drive, shouldn't be in charge of anyone, shouldn't manage your money ect...

What you definitely can't do is pick and choose as it suits, which clearly is how you see it.

I disagree. Many people with mental health issues fail to have full insight into the condition and difficulties it causes. Even if they drive and manage their own money.

Interview under caution + court. Same thing. Its a dealing within the law. The law doesn't care about your feelings it only cares about the law.

Telling the OP not to take it seriously is like preparing a lamb for the slaughter.

Well I agree there flock. If I had full control over my money I would have spent it all now stocking up on food because I believe the end of the world is coming.

Planet X etc causing climate change.

But my Dad has control over my bank account and I just have a pre-paid card. But then again this explains why I can save loads. Because my Dad keeps my paranoid personality disorder in check.

I've not read any comment that has suggested she doesn't take it seriously.

I have read everyone's comments and I definitely feel like the worst is going to happen.

I have all my paperwork for the interview, and I'll hopefully get someone from the CAB to come with me. Does anyone have any other advice for this interview if anyone else has been to one?

If this interview is truly about my pension then all I can tell them is that they clearly knew about it when they reduced my JSA income in September for it and now I am being interviewed under caution while on ESA 3
Months later about it, where I didn't fill in any forms by the way, it was a straight change over since it went to tribunal.

Does anyone know the likely outcome? Is it likely I'll appear in court?

I don't think anyone will be able to tell you the possible outcome. For a start no-one knows exactly what the DWP's position is.

I'd say try not to overthink this and try not to "what if" too much. Which is easy to say, I know, but does help if you can manage it! Do take someone with you, do take all your paperwork, do take time to think before you answer and be as honest as you can.

Even if someone from CAB can't come with you they should be able to talk you through the process so do get in touch with them

Imho I think it's highly unlikely it will end up in court due to the amount being revelatory low...Don't refuse to answer questions because that can rouse suspicions even if they are unfounded... Take all your evidence and be honest, some think even if a claimant has knowingly committed fraud the DWP are in the wrong pursuing it, but that is down to a hatred of a government department that they are or will maybe need help off in the future...
