    None. Even political enemies dont get sent to court for these kind of mess ups.

    Not strictly true.... People can be and are prosecuted for less than that. All sorts of factors come into play. That's why nobody can say 100% what will happen.

    My advice, attend, listen to their case and say no comment at this time.


    Read from a pre written statement at the start of the interview simply to say


    I, ______, did not knowlingly make any false statements, I have attended today voluntarily and am free to leave at any point, I shall be answering no comment to your questions at this time.


    Find out what they have against you, but don't give them more ammunition.


    And inferences are usually made by the court because the defendant answered some questions, but not others. No comment to everything.


    Q: nice wether today isn't it?
    A: No comment


    Q: is your name____
    A: no comment


    etc.

    Pensions affect ESA(C) and JSA(C) claims as well. There are disregards on contributory claims but over a certain level benefit will reduce.

  • Can anyone give someone an interview under caution? What I mean is if I suspect someone of ripping me off can I say I want them to come and see me to give them an interview under caution?

    I am puzzled how it works?

    Can anyone give someone an interview under caution? What I mean is if I suspect someone of ripping me off can I say I want them to come and see me to give them an interview under caution?

    I am puzzled how it works?

    Enforcement authority's can conduct an IUC in the legal sense- which is admissible in a court as the person has been asked to give their account/explanation as the authority is seeking to establish if an offence has been committed & that persons involvement. Hence the caution.

    As the caution will explain "you are not under arrest or detained here" which is why they are called "voluntary interview", as in the DWP can't make you attend.

    There was a Council in Essex that had to write off a large number of overpayments and refund money and pay compensation when it was discovered that some people giving interviews under caution weren't actually authorised to do it.
    These are my own views and you should seek advice from your local Benefits Department or CAB.
