We used to say someone was very shy. Now they have a mental illness and get benefits for it
I think your retort is extremely disrespectful to vulnerable people.0 -
Thank you, You are correct, as i do not wish to hide behind my illness to solve a possible mistake on my part! All i want is to get it sorted outside of a court room and pay anything back if anything at all, if a mistake has been made.
Thank you all for your continued support!
You are welcome!!
Can I suggest you make some notes to take with you- write yourself a chronology? I would also suggest you take the all correspondence with you.0 -
I was automatically switched from ESA from JSA as I went to tribunal for the ESA claim as I had lodged an appeal with the Tribunal Service, which I won and was awared Work Related actvity group ESA at it. I did not fill in any forms, I was changed over automatically within 2 weeks to my knowledge.
Also, I do not claim housing benefit as I own my home.
I didn't realise from your original post that you had originally been on ESA and then claimed JSA for the period your claim was going through the appeal. The same issue still applies though about informing ESA about your pension. If the pension was received during the appeal time you needed to let ESA know once it was reinstated. The timing though would go a long way to explaining any confusion about why the pension wasn't on the ESA claim, if that is the case.
If you aren't receiving HB I don't understand why the council is involved, but that's not really important at this stage.0 -
Possibly the council have an interest of the o/p is getting CTRS.0

Well during the appeal process of ESA you must go onto JSA, or so I was told and that's what I did, I think I originally went for my medical exam with Atos in June, and didn't get my appeal date until November, so I would have been signing on JSA from July 2015-November-2015 and I have a letter from the DWP from September 2015 saying they knew about the pension.
Its pretty confusing I know, the fact its at the councils office where I am could be a coincidence I suppose, but I'd have imagined it would have been at the job center if it only concerned my ESA/DLA.
You may be right though and this would be my fault, from November 2015 to now January 2016, I did not alert ESA of my pension due to the fact they knew about it when I was on JSA two months prior.
This is really just my mistake and was certainly not deliberate though!0 -
Do you know how much the overpayment is?0

Do you know how much the overpayment is?
I don't know about any overpayment to be honest, all I know is that I have the IUC and was recently moved to ESA, the money I get now may need to be reduced to include the earning of the pension, as it did when I was on JSA.
So if any overpayment has been made it would be that 3 months of ESA payments need to have money deducted from them, how much I am not certain though. If that is the overall reason.
I am totally lost with all of this, I have no idea why they are calling me in to be totally honest, all I know is that on the phone they said it was over a pension and this is the only pension I get and it hasn't changed or payed me anymore money. Which leaves me to think that I am being brought in to discuss why I never declared the pension when I was automatically switched from JSA to ESA after my tribunal, in which case as I have stated, I didn't know I had too declare as they were aware of it during my time on JSA and I didn't fill out any forms this time.
Any more help will be appreciated.0 -
Are you claiming council tax support, is that why its at the council office.0

Yes it could be, as it is kind of a knock on effect.
I find it possible it could be to get information on the pension (although they already had it?) and if it turned out to be significant enough then it would also affect my council tax reduction, thus making the joint interview more likely.
I know however that it was declared to the DWP and that it is not significant0 -

Hi Trona40. I did suggest this but the thought police decided to do a raid on me. I then decided it was a good time to !!!!!! and wait a while till they logged off.
You have to inform all departments of any changes. Council, DWP and Job Center. Its just the way its set up to reduce costs and make you do all the heavy lifting.
I still think you should play it safe. Don't be in a rush to claim things which you aren't sure about. If you have made a mistake and you have evidence that you made a mistake then best to admit it but as for everything else don't give the DWP fraud investigators a sniff of something where you don't know the end. They will dig and make conclusions based on weak assumptions.A_Flock_Of_Sheep wrote: »I think your retort is extremely disrespectful to vulnerable people.
Not at all flock. Some of us with mental illnesses are real human vampires.
I think able bodied people should have the right to express their grievances with those of us who have literally gone out of our way to cause harm.
I know I have caused a lot of harm on my time on this planet. I wouldn't be classed as a dangerous person otherwise.
But yet we live in a system where people like me are not given the death sentence but instead wrapped in cotton wool at the tax payers expense.
Ah well.0
