Parking Dispute

I am planning on contacting PE to request again a copy of the information they were apparently provided with using POFA as I do not believe they obtained the information from the DVLA as I was not the registered owner of the vehicle and will quote them. Once I get a response from DVLA re the D888 I sent to them I will also provide them with that (haven't told PE yet I have sent the D888 to DVLA) so think me asking for evidence they had from DVLA has helped with their quick response. Pappa Golf is it possible that the parking fine still stands then? I want to totally make sure everything is totally sorted. Still trying to get a copy of my credit report to check it (too many passwords/emails and can't remember them all!)0

Have taken pic of letter received from Equita but don't know how to upload it0

the parking charge has been cancelled , they have made a !!!! up and instead of going after the correct person , they have chosen to cancel it.
the fault here is the law , not parking eye (sorry I did not say that) , the law allows then to use a credit checking agency , and to allow PE to chase by simply accepting this.
in this case Capita are the masters , they own PE and equita , equita were probably used as the search agents.
so what next , the original driver has another charge a mth after the first , PE are doing housekeeping and clearing the files , whats to say ticket No 2 isn't with equita , who incidentally do not know they have passed false info on!
I would demand that all files holding the OPs data are destroyed , and I think equita should be reported for forwarding incorrect info by virtue of not checking it out,Save a Rachael

I have watched this very carefully and the Parking Eye letter is very interesting
In your first post you say "I have never had a driving licence and never owned a vehicle!"
The Parking Eye letter insinuates that in the first instance they obtained your information from the DVLA
They say "however, upon receiving no response from the Registered Keeper in relation to the Parking Charge"
This says that they did get information from the DVLA ??
As they had an address, why would they bother using a credit agency to obtain the same information when the normal practice is to pass it to debt collectors to follow up
Parking Eye continue to say "we received a phone call"
Did you phone Parking Eye ? If you did, you were not to know but NEVER EVER PHONE A PARKING COMPANY OR THEIR DEBT COLLECTORS
If this a result of you phoning them, then Parking Eye are proving and confirming to everyone .... NEVER PHONE THEM
Then they state this
"We can confirm that, to date, we are still not in receipt of any evidence, aside from the content of your emails, to support your contention that you are not the registered keeper of this vehicle and it is our position that we have reasonably relied upon the information provided by both the DVLA and the Credit Reference Agency when seeking payment of the amount outstanding."
Your email they confirm and as email is considered a suitable method of communication. How does anyone give evidence if there is no evidence to give ?
Parking Eye say "however, ParkingEye would dispute any claim for costs that you may wish to make in relation to this matter."
Of course they would, does not mean you cannot claim costs
The DVLA holds the key. they have to reply and you are waiting for this.
If Parking Eye are using credit agencies after they received details from the DVLA, they then have the credit history of everyone who they issued tickets to. They are not entitled to this information, they are a simple parking company but clearly they have access to sources not known to us
I am pleased they cancelled your fabricated ticket but ask yourself why did they cancel ? Personally, this smells so rotten that I would pass the whole scam story to the press
Hope you let us know what the DVLA say0 -
Beamerguy , just a couple of things
the only "letter" was from Equita , demanding monies on behalf of parking eye. the OP has never had Mail from PE
PE are registered as a data holding company , so cannot be pulled there.
the DVLA cannot give data about a person that is not listed on their records.
the ticket was not fabricated , it was probably correct , however the in house info they received was correct
they cancelled because there credit search Co made a balls up.
what is to say there is no ticket No 2 , equita have not been informed of their error
however , and this is a good one
Equita are not registered as a parking Co and as such PE are not allowed to pass information onto a non ATA member , remember we went thru this with ANPR , using the credit services assoc , and a statement from the DVLA that non BPA or IPC members were not allowed info for PARKING offencesSave a Rachael

What you are saying is every debt collector acting for PPC's are being passed information they are not permitted to have.
One assumes that to be a ATA member they have a registration number0 -
