Parking Dispute

Hi


I am being accused by Parking Eye of a parking ticket. The matter has now gone to Equita. Neither of them are particularly helpful and Parking Eye say I have take my dispute to Equita and Equita say I have to take my dispute to Parking Eye.


Thing is I have never had a driving licence and never owned a vehicle! They "claimed" to have got my details from the DVLA then backtracked and said they got my address from a credit reference agency. Can they get my address from credit reference agencies?


I have today sent a D888 to the DVLA which is a form requesting that they send me all the information they hold on me (which should be nothing!) which I will then forward to Parking Eye and Equita.


Which ombudsman can I take this matter further with? I had given them 10 working days as at 23rd December to provide written confirmation that the matter had been closed but they just do not believe me!


Any advice welcome please

    how can the DVLA give data on you , if they hold non?


    it is obvious that the "credit reference agency" has mismatched you


    have you a relative/family member with a similar name ?


    I await to see what the DVLA comments are




    do NOT ring or write to Equita or PE , but DO keep your eyes open for a letter before action of court papers arriving in the post

    Exactly my point re DVLA and credit reference agency!


    I'm not sure I will get a "letter before action" from them - Equita have told me on the phone it's close to bailiffs going round - no court papers have been received!


    I have kids at home and don't want the bailiffs knocking on my door scaring them and me.


    Refuse to give up and will battle on just want to know who I can make a complaint to?


    Can I ask why to not call or write to Equita or PE? Sorry may work in law but not used to having to deal with matters like this.

    STOP , equita tell lies


    this is a civil matter not a case in the crown court!!


    to get bailiffs knocking on byour door in a civil matter


    1: receive a letter before action , from either PE or their solisitors , NOT A THREAT from a DEBT COLLECTOR with no say in the matter
    2: properly serverd court papers
    3: county court appearance
    if you are found to owe the charge
    4: fail to pay within 28 days


    at that point PE can get bailiffs in if they wish ,not seem many if any cases so far




    but equita missed all that out did,nt they?


    equity are lying , this is what the do for a living , DO NOT ring or write to either




    you do know that PE and Equita are the same company?

    Baliffs??? Hang on a minute, has this case been taken to court, you lost and failed to pay within the stipulated time and received a ccj against you.

    Please clarify ?

    I have just had letters from PE saying I owe them money for parking fine in 2014. Thought it was all sorted until I had a letter from Equita at beginning of December saying they were instructed by PE to recover the sum of £150 so no court case/letters received to date.


    It is showing on my credit rating but definitely not been to court.


    ps didn't know they were the same company! PE told me not their problem and take dispute to Equita who are telling me the opposite!

    this sounds like the tail end of the mass mail drop that PE/Equita did before xmas , they sent out 100s of those letters and when contacted by posters lied thru their teeth with stupid threats


    equita is a debt collection company , owned by capita , who own PE , why should they get involved AFTER a court case?


    although this could be interesting , the OP not driving or owning a car .


    If they want to continue , they will have to start showing some REg Nos on the paperwork , then the fun will happen

    Pappa_Golf that link is exactly what has happened to me! Don't understand how I can get a parking fine when I've never had a driving licence or owned a car!

  • I presume they have stated the keeper is liable them having satisfield the requirements of POFA ?
    However
    Par 11.1"the third condition is that -"
    c. "The information sought by the application is provided by the Secretary of State to the applicant."

    So if not ..........
