i have just received a pcn from a co called LDK by post dated 23/12/15 for a contravention on 09/12/15 is this valid ?
there wasnt a parking ticket put on vehicle at time although a man said id receive one when the driver offered to pay?

This sounds like it could be an ANPR ticket which must be received by day 14 starting one day after the alleged event if there was no windscreen ticket.
If you had a windscreen ticket then the keeper should get the notice between days 28 and 56 starting the day after the alleged event.
LDK Security Group Ltd are BPA members so should be easy to beat with a two stage appeal.
Read the Sticky thread for NEWBIES and appeal as KEEPER using the template appeal letter in the NEWBIES exactly as it is. Nothing added, nothing taken away, just copy and paste. This is to make sure you don't reveal who was driving and give away a valuable appeal point.I married my cousin. this sounds like it is taking the **** out of the POFa2012 , its either an ANPR setup , YUP CAMERAS that record your entry and exit OR a bloke with a pen and ticket

it was a man with a pen and pad who was peering into the van when i came back.
He asked if i had a ticket and i said no as i wasnt aware i needed one.
I offered to put a ticket on for the length of time id been there and he said no youll be getting a ticket through the post!0 -

That's not allowed. It should be ANPR or a windscreen ticket. The operative should have accepted payment for time parked in order to mitigate the parking scumpany's loss. Naughty PPC but more PoPLA appeal points for you.
Another PPC (UKPC) recently been caught fiddling time stamps on their cameras so reference to that should be another appeal point at PoPLA.
So, as already advised, appeal using the template letter in the NEWBIES thread. It's up to you if you want to add the other points now but I must stress there is always a danger in doing that as you may give away the driver's details.

i also took photos from my position outside van showing no clear signage from where i was at is it recommended i dont include these initially?0

now according to the BPAs website http://www.britishparking.co.uk/Approved-Operators LDK are authorised to act (by the BPA) by the "ticket method" the ANPR aspect has not been audited or accepted by the BPA , as such they have applied for your info from the DVLA illegally , and have clearly failed to act within the confines of POFa2012.
as such , you can suggest that they chase the driver of the vehicle , not the owner.
further complaints should be brought to the attention of the BPA and DVLA.

The driver didnt purchase a ticket as he was unaware of the need to do so.
He was there for 2 hours and offered to purchase a ticket when pointed out by the guy taking details that he should of.0 -
upon returning to the site , did the driver spot signage stating that it was a pay and display location ? can you give location , and possibly a location/postcode to look at this on google maps (or a google map link)Save a Rachael
