Has anyone else noticed a news report in Scotland regarding a guy called Edward Wales who was being taken to court by Combined Parking Solutions for unpaid parking fines? He settled out of court for £3000 and granted he had parked in the same car park 33 times! but it has got me a little worried.

You have nothing to be worried about. This alleged event has no bearing whatsoever on your case.

Did you get one of these to make good use of the PPC and debt collectors letters? :D

Because it was settled out of court it has no relevance at all. The case was discussed here:

    http://forums.pepipoo.com/index.php?showtopic=104908

If you want to see how it really pans out for ppc when they go to court, rather than Perky's silly claims the keeper can be held responsible in Scotland, Google 'VCS vs Robb Dundee June 2015 Dundee Courier'. That's a real case that went to court and was unceremoniously thrown out as the PPC could not prove who parked the car.

Also bear in mind that Euro Car Parks have no clue about court claims, whether in England, Scotland or anywhere. I recall them failing hopelessly when they broke the habit of a lifetime and tried a multiple ticket case in England a couple of years ago. Had no clue about the legalities at all, must have been egged on by the fact it was about a four figure sum. They did not win.

    :)

Thanks Guys, as always great advice given to a scaredy cat! Loved the briquettes, by the way. Pity I don't have a wood fire any more!

Hi, I'm back! After over a year of no further communication I recently received another letter from DRP headed "Letter before referral for legal action".

Could this have anything to do with the Carly Mackie case in Dundee? And should I be worried? It's up to £130 now. My friend received the same type of letter a few days after me.

    Thanks in advance.

1000's of times it is said on this site ...... IGNORE DRP

THEY SPOUT TOTAL RUBBISH and yes, these scammers will pick up on the Carly case to scare you

Unless the PPC is told who was driving there is nothing they can do
THIS IS SCOTLAND ....... NO DRIVER NAME, NO CASE

Carly made a mistake ...... she was the driver

The Carly case has nothing to do with you as long as you do not say who THE driver is/was.

Pass this to friends and tell them to pass it on.
Also tell anyone who receives a letter from DRP .... IGNORE DRP

DRP are simple leeches who are bottom feeders attached to the back of a PPC

What makes you think that a non-precedent case in which a driver was admitted, affects other cases? I see you also worried about the Beavis case in 2015, which was also not applicable to your own case, was about an English location and was another one where the driver was known.

The Robb case which you Googled before, told you that each case turns on its own facts:

"Dundee man wins £700 parking ticket case

A sheriff has thrown out a private parking company’s case against a Dundee man who racked up more than £700 in tickets, branding the action “incompetent.”

But the decision will not act as a test case on the legitimacy of future private parking charge claims, a Dundee solicitor has warned.

Vehicle Control Services (VCS) took Mark Robb to the city’s small claims court after he refused to pay charges on tickets received in Trades Lane and Cross Lane between December 2013 and May 2014.

But Sheriff Alastair Brown dismissed the case and awarded Mr Robb expenses, saying VCS’s agent had provided “no evidence whatsoever” that he had been the driver of the vehicle at the time.

After the decision, Mr Robb’s solicitor Gary McIlravey pursued expenses at the level granted in summary cause cases rather than at the small claims court level.

However, Sheriff Brown told him: “I can only grant expenses on a punitive scale if they have conducted themselves inappropriately. On this occasion they conducted themselves incompetently but not inappropriately.”

Mr McIlravey said: “Each case will turn on its own facts. There’s no underlying legal principle.” "

The answer is 'Yes' if you've identified yourself as the driver and you've stacked up 200+ unpaid tickets.

    Otherwise the answer is 'No'.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

This is a last desperate attempt to get you to pay DR+, they don't want to "refer for legal action" as they won't get anything as they will have failed, as above ignore.
