Euro Car Parks Notice (Scotland)

Hi, First time for posting, please excuse any errors I may make. I parked 22 minutes over the 2 hours allowed in a Glasgow car park on 2/10/2015. I received a Parking Charge Notice dated 9/10/2015 for £70, reduced to £40 if I paid within two weeks. I have read MSE forums saying to just ignore if you live in Scotland, and have ignored the first 2 letters, but the third one ,from a debt recovery company, is quoting the Supreme Court case of 4/11/2015. I have until tomorrow to pay £130 or it goes to court. One forum spoke about the length of time between parking offence and DVLA giving out personal information could be too soon. I know I have left it a bit late to ask for advice but any given would be gratefully received.

    non valid in Scotland , as you have read (POFa2012 does not run in Scotland)


    stock up on the toilet paper before it runs out


    do NOT ring / write etc to either of them , they can only go after the driver. if you do not tell them who the driver was , they will have a hard time

  • Thanks very much pappa golf. I'm a middle aged woman not used to breaking the law.I was just worried about this new Supreme Court case, in case it applied to Scotland as well.

    I haven't contacted them, at all.

    the laws in Scotland are different when it comes to private parking , you have not broken any laws applicable to your country.


    the letters are "INVOICES" , and as such can be forgot about.


    several of the parking Co,s have tried this in Scotland , only to be charged by your PF for obtaining monies and fraud,

    forget the dates and timing of letters , as the rules for those are rules set by the English government to govern private parking in England and wales , NOT SCOTLAND OR NI!


    I would say that euro/debt collectors are sailing close to the wind by quoting a court ruling from another country.


    look carefully at all the letters and future ones , if the phrase "POFa2012" (protection of freedom act) is mentioned anywhere on them , please reply

    The letter has a box on the back entitled "Liability for this charge" stating "the driver of the vehicle at the time is responsible for payment of this charge, however in certain circumstances, set out by POFA liability may be transferred to keeper of vehicle. This applies to tickets issued in England/Wales etc"

    That's the only place it mentions POFA so I guess it's ok, for now!

    As advised in previous forums I have kept all letters.

    And thank you so much for all your help with this. I really appreciate it.

    Reading all about Civil Enforcement Ltd and the newspaper article.
    Although it is dated in March 2015, does anyone know if the
    Aberdeen Sheriff Court has gone further with the fraud claim.

    what is very disturbing is they are using scare tactics citing the Beavis case and saying "Is my Parking Ticket Enforceable?", then going on to give the impression that ALL tickets are enforceable ?

    WE know that is not true ?

    They are a BPA member so what on earth are the BPA doing to stop this fabrication and lie, very little I suspect.

    Let's hope that Civil Enforcement Ltd are done for fraud, even though it's Scotland, it would not go un-noticed in Westminster

    We all know its fraud yet it seems to be an approved fraud in England by Westminster

    The SC ruling does apply to Scotland, insofar as it relates to contract law (AFAIK). But the absense of POFA and keeper liability together with most PPCs' ignorance of how to use the Scottish court system means that none of them go near court in Scotland.

    Hopefully the regulars have put your mind at rest and you can now get on and enjoy the rest of your life.

    If you get any more paperwork, consider getting a wood burner and a paper log maker to make use of your free supply of fuel. :D

    No need to be scared of Euro Car Parks, who would not have the first clue about a small claim in England, let alone Scotland where they don't know who was driving - they need to know because they can only pursue a driver but you are not going to say, of course! Because you are not going to appeal or do anything.
