    Foxtrotoscar, as a qualified solicitor (albeit non practicing) with 2 law degrees under my belt I can assure you that England and Wales have had the same legal system for hundreds of years. Scotland is different in several respects but Wales is not.

    The Welsh Assembly is a political body, not a legal one. It has certain delegated powers to make regulation specific to Wales and the Welsh people (as in those resident in Wales), it does not have the power to override laws enacted by Parliament. Such laws apply automatically to Wales unless specifically stated otherwise. The opposite is true of Scotland and Northern Ireland, which must expressly be included for a particular act of extend to those territories.

    Road signs in Wales are not legally required to be in Welsh and English. They are because there are still a number of people for whom Welsh is their first language. This number is dwindling as time goes one, but equally it is considered one way to maintain Welsh linguistic heritage.

    Might I point out that, intentionally or not, you have come across as quite antagonistic and unpleasant on this thread and have purposefully nit-picked at very minor aspects of people's posts, ultimately hijacking the thread away from the OP's original question. I don't wish to sound high handed but that's not really in the spirit of an online community, is it?

    I'm not sure on the rules of the security guard issue are but I do know that once a customer has left the store with items they believe have not been paid for they have been seen as committing a crime and anyone can make what is called a Citizens Arrest (even people who are not designated security guards.) This is totally legal, and if for example the security guard had committed a crime by (for example) taking the bag from the customer without having been given permission or had broken items in the bag and refused to compensate, it would have been just as legal for the customer to make a citizens arrest on the security guard and call for Police to resolve the matter.


    I'd ask your friend to contact Boots and explain what happened. There is no reason Boots should resolve the situation but if I'd had a poor experience due to shopping in a store, I'd want the company to know about it.

    Unless someone complained and an investigation discovered there was no attempt to restock with the freebie offer. This is then considered to be misleading advertising and the store could be fined.

    Low value shoplifting under £200 is a summary only offence but is still treated as an indictable offence for the purposes of PACE.

    What is the definition of "reasonable grounds" ?


    • A store worker advising the store detective that they have definitely seen a customer take and conceal an item
    • A store worker advising a store detective that they think they may have seen a customer take and conceal an item but can't be certain
    It appears that store detectives have certain rules that need to be followed too
