I'm lost with what a lot of you are saying. Should I still appeal using the method in the newbies sticky?

You also appear to be ignoring some other questions.

Pay the charge and learn from it.
  • I've answered any relevant questions though
  • I've answered any relevant questions to this. Other than one about a sign.
The sign only says you can't parked in marked bays for more than ten minutes. I wasn't even in a bay

    I give in!
  • You'll have to forgive me for not knowing exact protocol on this website or that my case isn't different to the others. I'm clearly new here.

This is going round in some half arsed loop.

You need to state: what happened and why you got a ticket- exactly, was there a disabled person in the vehicle at the time?
no sugar coating no this or that just the facts.
As with all things if you are honest and open you shouldn't have a problem, dont forget that this is a public forum viewable to anyone with an internet connection so be honest and dont make anything up.

So from that start, vehicle parked somewhere on car park/site thats infested with highview, was this tesco? if not then who?
Vehicle was parked there as an occupant was/has a disability that affects movement ( or other such disability )
No actual obstruction was caused be the vehicle being in that location?

    is that correct?

    Start again form the beginning
    From the Plain Language Commission:

"The BPA has surely become one of the most socially dangerous organisations in the UK"
  • That is all correct apart from the disability part. The driversmum has a badge and told me I stand a better chance if I say He was helping her. Although He wasn't.
  • It wasn't tesco either. It was a place called the galaxy centre. Has a cineworld and nandos etc
No real obstruction was caused. Was parked parallel with a skip and it was on a Friday night.
Was not parked in a bay either

Highview are easy to dispose of if you follow the advice in the newbies sticky.

    1. You read it and understand it.

    2. You send the initial appeal (exactly as per the template - no story, and no lies - nothing, just what it says in the template) and you send it off as per the prescribed timing - Christmas or no Christmas!

    3. You wait for your (guaranteed) rejection by HV through which you get a verification code to access the POPLA appeal process.

    4. After sending off your initial appeal (template) to HV, you read up and understand what the POPLA process involves - you read until you understand it. Post #3 of the sticky plus reading the more recent POPLA decisions from the other sticky 'POPLA Decisions' will give you a good understanding of what's needed.

    5. When you get your POPLA code you draft a POPLA appeal (informed by the reading you've done as per #4 above).

    6. You put your draft up here for regulars to scan over to ensure you've got the right points covered (but we won't proof read it, nor will we rewrite any old 'copy and dump' you throw in here).

    7. You send off your POPLA appeal within the 28 day deadline - no extensions allowed, you MUST get it back to POPLA by the deadline.

    8. You will get HV's Evidence Pack which they will send to you and POPLA - you will need to rebut any of the points they raise that are wrong or you disagree with (examples of how to do this will be linked for you at that stage).

    9. You only need 'win' one of the half a dozen appeal points you put to POPLA - and the charge is dropped. HV has to 'win' on all the points you raise for the charge to be upheld.

    10. If you win - that's it, game over for HV, the decision is binding on them. If HV win, the decision is NOT binding on you. You still don't have to pay the charge.

So that's the process in a nutshell now it's down to you to do the further research and legwork, but the sticky will guide you through most of that.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
