Sorry, back to page 3....
We have had 4 battles with PE. Won 3 and lost 1. We only lost one as another daughter did not want to bother with court and we settled for £60 by mediation. To be fair she did break the parking rules at the car park, so we were fighting the claim on technical issues.
But this Equita thing is just ridiculous as we and I am sure most people have no idea what the debt was.
I am not giving them my daughters address in the USA as I don't want her troubled by it. I may however send them a letter to say that the person they seek is no longer resident at this address.... I will do the same with all other correspondence should there be any. See what happens.
I would do the same as you, would be different if it was a legal authority like the police but these are just scammers after money. and nothing else0 -
Y'know, I don't have a problem with newbies wandering around here in wide-eyed amazement about this brazen "industry", and wanting to see something done about it, but they are doing no-one any favours by pretending they are experts, trying to teach their grandmothers to suck eggs, and giving frequently-wrong advice.
And good morning to you. Well I am not a newbie, been on MSE for 6 years, maybe you post more but the simple fact is that this is happening because a couple of years ago, everyone was saying to ignore them, bin the letters, even a solicitor on watchdog saying turn the letters into paper planes ?
Clearly that was wrong advice hence what is happening now
I am not attempting to be a legal begal or anything like. As said before, when I joined MSE it was for the banking scam, I helped a lot of people get refunds, even drafting letters for them
I have also said that I am Parking ticket free and everyone was cancelled that I have had in the past plus wins with the Traffic Penalty Tribunal. Plus two run in's with local councils and with the help of the press left them with egg on their faces and facing massive refunds to motorists.
I do it my way because there are many more ways to skin a cat.
The current Equita problem can only relate to previous bad advice0 -

Why was it 'bad advice' when keeper liability didn't exist?
How would you presently advise cases in Scotland? Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Its debatable advice, the reason is we can simply not rely on Judges in county court cases, an interesting nugget appears to be that capita are members of the law society SRA ID: 498089.
Those who know what the law society do and there honour code of ethics to uphold members "privileges" as we shall call them means you are in for a very short thrift kick up the backside when asking another member of the law society to rule against the first.
This is why beavis should be taken to Europe on its breech of consumer contract regulations directives , to get it out of law society hands and in to an "independent" arena.
In short, you are not going to beat them when fighting in their ring under their rules when both are in the same "big club".I do Contracts, all day every day.0 -

Have you actually heard of POFA 2012? Do you understand how it changed the game? Do you know when it happened (hint: the clue's in the name)? The current Equita problem can only relate to previous bad advice
Whatever. Have it your way. The lunatics have taken over the asylum. You and Enfield Freddy (or whatever he calls himself now) and all your new buddies can just carry on pontificating and dishing out junk advice, I'm done with this forum, you are wrecking it. Have fun.Je suis Charlie.0 -
I know that but the fact is Equita have jumped on this, I am in England so have no idea about Scotland, cannot help you with that one
Really? Not what you said just a few weeks ago!Just to point out that I am fully aware of the difference between English and Scottish law.
