Think I've messed up parking eye

  • I haven't admitted I had no other choice as there was no where else to feed my baby home bargains has no baby feeding and I still would have been over the time limit. Is there anywhere I can get an appeal template for the grounds of having to feed her? (She's breastfed so feeds often)

    .You have to play the system. Anyway, it was just my opinion and thoughts. Obviously I was wrong.
    Advising to agree to pay on the drip but then stop is so bad. (Or are you again by saying "obviously I was wrong" telling us you just posted another of your hilarious wind ups?)


    (Were she to take notice of your "advice" you are really steering the OP toward to s a certain CCJ and all the hassle that comes with that - how is that "playing the system"?)

    A 'parking charge' ref 1234567910 was sent to the registered keeper of xxxx on the xxxxI responded directly to Parking Eye via appeal online on the xxxxx


    As advised to Parking Eye in the above referenced letter, the driver on the day was a breastfeeding mother as such is a person with protected characteristics under the Equality Act 2010 and is legally entitled to use when needed, a 'reasonable adjustment' such as, in this case, additional time to feed their baby as already stated in the previous mail


    Parking Eye have been informed and have chosen to ignore this fact in continuing to pursue the registered keeper for payment of this ‘Parking Charge Notice’. This is a clear breach of the Equality Act 2010.

    This bullying of those with protected characteristics does not represent home bargains in a good light at all - as a direct result of this, home bargains have now lost the custom of our whole family who previously shopped at the Jarrow store. Not only that, this is clearly harassment which is illegal.


    Take notice that I will regard any further correspondence, save as may be required to litigate matters between us or to confirm that the matter is closed, from you, your agents or assigns as harassment within the terms of s.2(1) of the Protection from Harassment Act 1997. Harassment is also another Equality Act breach in its own right, and citing either/both Acts, I will also reserve the right to seek damages from you home bargains and Parking Eye who are jointly and severally liable for these unlawful actions).

    I now assume the matter is closed and sincerely hope that home bargains takes action to stamp out this illegal practice by your agents.

  • I have seen this tactic many times Quentin, and it works. From parking charges to the utility companies. The cost of pursuing becomes prohibitive so they stop. Pleading poverty also helps somewhat. But seeing as you are a much higher life form than me, a mere termite, I shall keep my thoughts to myself from now on.
    It was just a suggestion to the poster if she wanted some variations in options

    Please can someone help me with the popla I have no idea what to write I would greatly appreciate it

  • Ok thank you Quentin. I'll have a look it's all consuming advice I've been reading on the forums some are saying go for sexual discrimination and the fact the sign is quite high up located on a lamppost not easily seen?

    Excellent!

    First thing is to go here: http://www.parkingcowboys.co.uk/popla-code-checker/
    and check the expiry date of your POPLA code. Do not miss this deadline!

    Then, have a look through the Newbies thread and learn the meaning of some of the acronyms and other terms, to help you understand what you're dealing with.

    Have a search through this forum for examples of a recent Parking Eye appeal from , say, the last 6 weeks or so and use that as a starting point. Remove any points with regard to non-compliance with POFA.
    You could also add in a point about the Equality Act 2010 - do a search on here for "feeding baby" or similar to see if you can find any similar cases.

    Once you have a POPLA draft, post it in this thread for critique and you'll get help in fine-tuning it.

    This can be beaten, and you will get help on here, but you will need to put some of the groundwork in yourself, as above.

    I know it looks daunting to a complete newbie, but you'll learn a lot while you have fun doing it :)

    Great! You will be OK now, it's all downhill now you are at POPLA stage I would expect. We'll help.

    Show us the draft you come up with and we'll assist. DO NOT RUSH IT, you have 28 days from the rejection letter but check the POPLA code checker to be sure. And overstay of 15 minutes is likely to be allowed anyway under the BPA Code of Practice 'grace periods'. See here for a few clues on what to include:

    But do NOT copy his entire POPLA appeal, obvs, because his is about a pay and display car park and I gather yours was 15 mins over 'free' time? I'm showing you that one because it's got up-to-date stuff about grace periods and about the 'no GPEOL' argument. You need to set aside some time over the next couple of weeks to come up with a POPLA draft for us to help you perfect.
