UKCPS sent letter for money, but I wasn't there?

edit post #1 to give the correct UKCPS name and also edit the title of the thread (advanced edit in post #1) to again give the correct PPC name
UKCPS are an IPC member so read the info in the NEWBIES sticky thread about IPC members and also read parking pranksters blog dated 30 oct 2015 as well
NEVER phone a ppc or debt collector about these matters
ps:- UKCPS are not claiming that YOU were there, they are claiming that THE VEHICLE was there, totally different set of facts
What's a ppc?0 -
What happens if I ignore them?
The paper they sent is a joke, it's obviously a scam! I am moving soon, honestly when me or my car were no where near that location, why should I bother?
chances are they will try to win in small claims court for an outstanding unpaid invoice sometime in the next 6 years , especially if you are moving house so dont get the paperwork
POFA2012 makes you the RK liable, thats why you dispute it , otherwise you are deemed to have accepted the matter and can be held responsible
ie:- you will sleepwalk into a CCJ which could affect your credit rating
acronyms are explained in the NEWBIES sticky thread, which everyone should read
post #1 still needs editing
and yes they can take you to court, and UKCPS do so at approx 1000 per annum at the moment0 -
I wasn't there. My car wasn't there. This is ridiculous, what do I do?.............................. Should I try and prove me and car weren't there?0

See post #10. IamEmanresu is a very knowledgable poster here and on PePiPoo. Follow his advice with confidence. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

PPC = Private Parking Company.
UKCPS do court occasionally so ignoring may not be ideal here, unless you fancy the hassle of having to fend off a court claim (and that IS a lot of hassle).
I would send them a letter similar to the one IamEmanresu suggests but maybe add that you require them to hold on to any photographic evidence they have as this may be required by the police in the event that this turns out to be an incidence of the cloning of a vehicle.
They'll then look at the photos, realise they've b*ll*cksed up on reading the reg properly and either leave you alone, or stupidly try and press their ticket on you, at which point they'll begin to look more and more foolish.Je Suis Cecil.0 -
If they can't show the photographic evidence, am I out of this? How can me and and car be proven not to have been there? Showing where my mobile phone was? get evidence from girlfriend that she was with me on that day, but day was a month ago and I can't remember..0
-
its not about proving where you or your girlfriend or your mobile phones were , its about UKCPS saying your vehicle was there (due to the VRN) and they are holding the RK (you) responsible for the vehicle being there (identified by the VRN they extracted)
even if a joyrider or a friend had taken the car and parked it in Newark, YOU would have received this unsolicited invoice as RK
follow the previous advice already given, by letter, with free proof of posting at the P.O.
this is an example of what to expect if you dont challenge it

The PPCs are scum, but you have to jump through some hoops to prove them wrong; simply ignoring them could lead to the award being made against you if it goes to court (even if you and your car were elsewhere).
It's a bit like treading in dog muck; like it or not, you have to clean it off your shoe!0 -
You've (unfortunately) got the attention of a very seedy nasty little company.
You shouldn't have to deal with it at all, and they would probably never ever win in court, BUT.... dealing with it now will be a lot less hassle than dealing with a court claim, and this lot do issue court claims.Je Suis Cecil.0 -
So tomorrow, I will give them a call. Went to the police today and she said call them. Surely they have to show and tell me the make and model and colour of my car. If they don't have the correct make and model then obviously someone has cloned mine. Surely if there description doesn't match mine they have to driop hassling me?
Shall I get CCTV evidence from the police of my local area to prove I was in the South Coast and not up North which they are claiming? What evidence should I gather?0
