car problem too far from dealer who sold it

    All too often people think the worst. A tiny fault and it needs a brand new part from a main dealer when quite often the fix is much cheaper.

    A split boost pipe maybe the cause but diagnosed as a new turbo being required, they may chuck in a new pipe for free or tell them the pipes are old and brittle so best to change them as well.

    A split boost pipe, or dying / dead turbo wouldn't cause it not to start.

    a dealer on gumtree, who after i paid wrote "sold as seen" on the invoice,

    A dealer can't write that and even if he writes it, it does not relieve him of his duty that goods sold must be of merchandisable quality.

    I am surprised real dealers selling thru Gumtree!

    If he is not a real dealer then it is private sale and no comeback.

    If he is real dealer then take him to Trading Standard.
    Happiness is buying an item and then not checking its price after a month to discover it was reduced further.

    Any dealer that writes 'Sold as seen' on the invoice is one to be avoided at all costs.

    His kind offer is to get someone to do it cheaper, and let me pay.

    Not good enough. You need to write to him, quoting SOGA and his responsibilities under it. Plenty of templates available online.

    LOL What a super chap he sounds!

    Unfortunately you have to give him the chance to put the car right then somhow get the car back there. If he isn't interested in looking at it and fixing it for free, then its an uphill struggle by the small claims court. Best to deliver the car back there and say you are rejecting it under SOGA. Eventually you might get your money back or the car fixed but sounds like it will be a fight.

    Firstly speak to trading standards. As previously stated he can not put sold as seen. This is a breach of your rights. As of 1st October 2015 you are covered by the Consumer rights act. You can claim a full refund in the first 30 days,providing you can prove the fault was there at time of purchase. If you can't prove that then the goods must be of satisfactory quality. Within the first 30 days you do not have to give him the opportunity to repair the car. I also believe unless it is stated on his terms and conditions that you have to return the car for a refund then it is his responsibility to pick up the car or you are entitled to be reimbursed any expenses you incur in returning the car. The law is firmly on your side here. He is probably hoping you will give up and go away. Don't!
    Get trading standards involved. Tell him you will claim for a hire car until he sorts it out. Tell him the garage are charging £10 a day storage for which he will be liable. Tell him you would prefer to say on social media how helpful he was.

    How do you suggest he speaks to trading standards? I didn't think they dealt with joe public direct. It's good going in hard but the dealer doesn't sound like the sort to play by the rules.

    Hopefully he will see it is cheaper to refund or repair rather than go to the small claims court.
