    Well they didn't call me back.

    Does anyone know who I can complain to? This decision makers diatribe has more holes than a cheese grater.

    No idea but thats awful .... wish you luck on your MR and hopefully they will be able to see the holes in it.

    I would start with my MP and work upwards !!
    but you SHOULDN'T HAVE TO go through the stress of an appeal - should you ?

    sorry but thats hilarious, a paraplegic that can walk 200m!!! i have yet to go onto pip but had loads of grief with atos years back, what people dont think of is governbent depts like dwp have an Official Complaints procedure, not an appeal or reconsideration as they are different, moaning to the person on the phone is what they expect. To cut a long one short i insisted on the official complaints dept details and kicked off to them( i can only assume that this means it goes on an official register or something). I didnt get near an atos doctor or interview and within a week i had a phone call from a dwp decision maker and everything was reinstated immediatley!! last year i got a letter from them about transferring to ESA from incap and filled in the form expecting to get summonsed before a "medical professional" , i enclosed 3 surgeons reports, 3 mri scan reports and also 3 pain clinicians reports( i have a degenerative spinal condition) , mentioned on the forms that i had "highlighted" all the relevent parts for them and got the ESA approved without going near a "medical professional" . If anyone is summonsed for an interview i would strongly advise asking for the interviewers medical qualificatioons at the start of the process as i hear they can employ anyone, a friend did this and was told by the interviewer that " we dont give out personal information " to which he replied " im not asking for your address and DOB but you are presenting yourself as a medical professional and i feel it important to know what your level of expertees and capability of understanding my condition are" The interview was terminated and benefits reinstated. i know times are hard but small covert recording devices are cheap on ebay and i would urge anyone and everyone to get one and covertly record the assessment (call it document if you prefer) as its a sure fire way of proving what happened and getting these jokers out of the system. if enough people did this and put them alltogether on youtube then the public would see what disabled people are put through in order to get what they are entitled to and might stop believing the propaganda that we are all just workshy scroungers, as above i would contact my mp and ask them to get details of how you make an "official complaint" about the DWP's treatment of you, its amazing how quickly these contractors jump when they think their behaviour might be brought up in parliament, good luck and hope it all works out for you soon

    You may wish to complain, and that is your right, but the normal route to challenge a decision is to ask the Decision Maker to look at the decision again, known as a Mandatory Reconsideration. This can be requested over the phone, but I think you stand a better chance if you put it in writing, refuting the points made in the written reasons given by DWP for the decision.
    If the decision is unchanged, you can appeal.
    Time limit for each stage is one month.

    I would contact your MP, this is the type of situation that warrants an intervention from someone who has a bit of weight behind them.
    I didn't have to have an assessment for my DLA or ESA so haven't yet had the pleasure of meeting any assessors but my time may come so I'm definitely going in prepared to be thwarted...Should be fun!!!
    I read something fairly recently about claimants having the right to see the assessors notes...I can't find it though, but it maybe incorrect..
    I'm going to do some digging.
    Good luck with your MR hopefully it will be looked at by someone with a bit of common sense.

    Did you have a home assessment - or did they require you to attend an assessment centre ?

    I went to the assessment centre. I'm iatrophobic and won't allow a doctor to violate my home but I don't think I would have had a home visit anyway.
