    So what happens if say in IE you bring up a new tab and select In Private Browsing ... does that only stop a record of sites visited being recorded on your PC ... but still allow the ISP to keep a full record of your activity?

    Yes, the ISP will still record this in "private browsing"

    What will be more interesting is how the free coffee shops wi-fi's etc are going to handle this.
    Their own ISP will be recording all the websites from all the customers en-masse from the coffee shop's IP address.
    Is the coffee shop going to have to keep a legally verifiable and audit passing record of which customers were connected to their wifi at any instant and how are they going to do this....and just having customers enter up some spoof email address on connecting does not seem to pass the test of such a record.
    Edit: I suppose they could keep a record of each devices' mac number - but its all going to mean more cost.

    Trivially spoofed.

    They only traverse the local network segment anyway, when I post this MSE has no idea what my MAC address is. A coffee shop would, but like I say, you can set it to whatever you like.
