if this was the case how come on countless occasions the manager at the said Total Fitness has rang your company instructing all tickets to be cancelled with immediate effect due to lack of contract? not to mention the bogus 'Miah' Solicitor letters which have also been cancelled.

once again a pathetic scare tactic to get people to pay up, if you was so confident you would just wait until the court date to prove yourself.

quick update,

small claims court has changed the location of the hearing to my local court in Warrington. awaiting further instructions.

furthermore I returned home tonight to find yet another letter from the good old jokers Miah solicitors demanding their usual nonscence fee. this relates to yet another date!

when and who are going to stop these guys? is any authority with the power to stop these fraudsters even bothered? they don't seem like they are to me!

Update!!

submitted my defence to the court and to UKCPS.

Sure enough few days letter i received a letter stating that UKCPS do not wish to pursue the claim and are dropping the case.

note to ALL dealing with UKCPS. DO NOT pay up no matter how much pressure they put you under, This is a prime example of the bullying tactics they use in order to press for payment.

UKCPS was clearly expecting me to say 'O i cant be bothered going to court i will just pay'

they knew full well they would not win the case.

if i had the time i would counter claim for my expenses and time wasted putting together my defence!

If anyone needs a copy of the defence letter i used (which obviously worked) then please message me.

The problem is that we have a government who seems to approve these scammers, the DVLA who approve giving our personal info to scammers and a court system who are unaware of the scammers.

Now that you are armed with their withdrawal, you should gather the evidence together and make an appointment with the CID office that covers the area where the gym is. Make your complaint of fraud to them, making sure they realise that you're not just 'moaning' about receiving a parking ticket. Explain what you have been told by the manager of the gym and show any relevant paperwork.
Even if it turns out that UKCPS do have permission to ticket the gym, it still needs investigating once and for all, so that gym members can go about their lawful business without being harassed.
