    It is definitely a fraud and the "it's a civil matter, sir" should be taken up as a complaint against the police.

    If, as they claim, this is contractual charge, it is a fee for parking, and thus vatable. Have they accounted for vat on their paper work? If not it becomes a breach of contract. No vat is payable but it can only be sufficient to compensate them for losses arisingfrom the breach, i.e., no staff uniforms, N.I. contributions, no electricity, business rates etc., a GPEOL in fact. In many cases this loss amounts to nil.

    Ask then for a vat invoice. If they ignore your request, (which they probably will), it is a useful stick with which to beat them if it ever gets to court. You could argue ex turpis causa.

    Your standard copy'n'paste response which you put in all UKCPS threads is not helpful in this case, and not particularly relevant where far more dodgy things are going on.

    UKCPS use the BPA logo on all their correspondence as well as their website.

    upon checking the BPA approved members they are not on the list.


    can this be also used against them in court?

    Not as a general stick to beat them across the head. But if this representation has hampered the resolution of the case prior to court, I reckon it is fair enough to bring it up.

    They are not members of the BPA AOS - identified by a roundel surrounding the BPA oblong logo block. They are but corporate members; the BPA CoP does not apply to them.

    In contrast they will be displaying an IPC AOS logo surrounded by a roundel. The IPC CoP applies to them - but they all seem to ignore it, and the IPC appears to provide no disincentive to doing so!
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    Not at all. It's just that it's a bit of a side issue in this case, where the entire validity of the charge is in question.

    I cannot see that. You are focussing on the parking outfit defrauding Customs and Excise - which, let's face it, it not a direct concern to us, it is actually an argument to make a point.

    ST is making the argument that in this case, what is happening is that the parking outfit are attempting - and succeeding - in defrauding ordinary people by issuing fake invoices. Fake because they have no authority to manage parking on the land in question.
