UKCPS LTD Scam

hello all,
first time posting here and regrettably with a bad experiance.
my dealings with the above mentioned "legitimate" parking wardens have been very frustrating.
The total fitness gym that I go too has a car park and because of numerous break ins and damage to cars late at night they advised customers too park in the disabled bays at the front of the gym if not too busy (as there are far more disabled bays than actual disabled people who attend the gym). there was signs up saying the car park is monitored by UKCPS and myself and a few other lads all received fines for £100 each time, however when we took the fines in to the manager he contacted UKCPS numerous times and told them to cancel the fines and stop coming on his land as they have never had a contract to patrol the car park with total fitness they only was given a trial period over 2 years ago but no contract was written up and they was told to stop patrolling the car park due to their harassment. however they continued to place tickets on people's cars and the manager had to keep on cancelling them. solicitor letters have even been issued with the manager cancelling them also. I have had about 5 or 6 cancelled and they've dropped it however for one of them now I have received a letter from the small claims court saying I either have to settle through mediation or attend a court hearing.
where do I stand with this? as I simply can't just ignore it as I am worried a CCJ will affect my credit rating? do I have any obligation to attend court which will mean a day off work and travelling 3 hours away to their court and producing my defence? it seems obscene when they have never been given the right to patrol this car park!
the manager of total fitness is pulling his hair out in frustration and the scary thing is a lot of the older guys in the gym are paying them straight off! I cannot believe such fraudulent activity can be allowed to take place!
any advice on this matter would be appreciated.
regards

ok , lets get this thing sorted
1:no you do not just forget about it
2:you get it transferred to YOUR local court
3:you go in there with a signed letter from the gym saying they were not hired , and walk away with money in YOUR pocket!
sit tight , and await more answers0 -

cheers mate.
the manager is getting me together a document stating the lack of contract etc. I can't believe they have the cheek to go to court knowing they do not have a valid contract! sounds like they are trying to scare me into mediation? I will be making a counter claim if it goes to court for my time and loss of earnings!0 -
, you need to achnolage the claim , this gives you extra time , get it moved to your local court , forget the counter claim , you are just going to charge them £18 (or is it £19) per hour for your time researching , plus your days wage + travelling costs
forget the mediation , once they see the letter they will back down.
the IPC might just be annoyed that they are working on land without permission
are there any signs on the car park?0 -
Yes there was signs on the land, however the manager soon took them down after they continued to patrol without consent. I cannot recall whether or not the signs was still up when this ticket was issued as it is going back to February of this year.

You might want to keep an eye on this current thread with the same protagonists - Total Fitness and UKCPS. Very similar scenario and with court papers just served. Whether it's the same location as yours, I'm not sure.
You might want to check things out with the OP there via PM. I'll also go to that thread and cross reference to yours.

thank you very much for the link!
very interesting as the manager of the total fitness has stated other total fitness gyms have been having the same problem!
the similarities are incredible between the two cases! particularly the ticket date being February the same as mine!
I will contact the owner of the thread directly!
thank you!0 -
This sounds like a fraud and a criminal offence to me. I would suggest you visit your local constabulary once you have got something in writing from your gym manager. Get everyone you know who has been affected by this to do the same. Don't be fobbed off by the civilian on the front desk.
You are reporting a crime and you want a crime number.
Also, contact the local press.I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
I have the same views as they are scamming a lot of people out of their money. seems to be a numbers game with them give as many fake tickets out as possible with the hope a percentage will agree and pay up.
the manager of our gym has filled a complaint with the police but the police have stated it is a civil matter!
I have also informed the IPC who isn't shrugged me off!
I cannot believe how these companies can get away with making thousands of pounds by scamming people out of their money with no repercussions!0 -
It definitely is NOT just a civil matter. They are doing something very similar to Aidan Thompson in Plymouth, albeit on private land. Can't post link but a quick search will easily find many references
What the manager might want to do is stick up a counter-sign stating that any employee of UKCPS entering the site is committing trespass and an action for damages will automatically follow. :-)
A photograph of them doing so would be even better.
Even if they didn't drop it and proceeded to court UKCPS would have to show the contract that they don't have allowing them to actually do so. Point out that if they have no contract and their Statement of Truth says they do then whoever signed it would presumably be guilty of contempt of court.
Also drop a line to the head office of both Total Fitness and UKCPS. If Total Fitness don't take action on being directly told about the problem then you could probably make a case that they become responsible for it.
Has the manager put up a sign to say these low-life are not actually authorised and possibly refer people to this site?0 -
It's definitely criminal just like this case where the crooks were jailed for sticking fake parking tickets on cars in disabled bays in supermarket carparks
