The appellant states that the charge is not a genuine pre-estimate of loss, the operator has no landowner authority or standing to pursue charges nor form contracts with drivers. I acknowledge the appellant has raised numerous grounds of appeal however my appeal response will focus on signage. The operator issued a Parking Charge Notice (PCN) to the appellant as no valid permit was on display. The operator says that there are 100 signs, throughout the site stating the terms and conditions. The operator has provided landowner authority that states that there are 92 signs; this was recorded in 26 April 2014. Section 18.3 of the British Parking Association (BPA) Code of Practice states “signs must be conspicuous and legible and written in intelligible language so that they are easy to read and understand”. The operator provided a copy of the signage at the site and what it should look like along with what the terms and conditions say. Based on the eight photographs provided as evidence by the operator I am not able to establish with any certainty what it the signs say. I am not satisfied, based on the evidence provided, that the appellant would have been able to see the signage and therefore would not be able to establish the terms and conditions. Accordingly this appeal should be allowed.

You are safe to say now on this thread (I don't take pm's anyway).
I can think of a case today, where citing that decision to show POPLA what their Assessor should have said re the signs, would assist greatly. That's a great example of an Assessor who realises that even 90 - 100 signs doesn't mean there is evidence they can be clearly read.
If we could say 'In POPLA decision xxxxxxxxxx, Assessor Fred Blogs said...' then it has more clout than just saying 'some other decisions said this...'PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
