So lets be clear. They use a system that needs to be fully completed prior to any contracts being created, printed and signed.
They were able to bypass this certain requirement (which sounds to be at managers discretion) using a code, that if it wasn't entered, the contract couldn't have been produced, printed and signed.
That to me is proof that they accepted the short ownership. If they didn't agree to it, they couldn't possibly have created the contract (unless they didn't check the length of ownership, but there is a prompt to do this on their system). Both parties agreed and signed the contract.
Basically to me it sounds like a manager authorised a sale that he was clearly in a position to do, but then his manager got mad and they are trying to wriggle out of it.
As others have said, you can fight this and probably have a good case, but it won't be quick. If you need the cash quick, sell the car for about £500-1000 more on AutoTrader, which should still see it well priced and sell quickly. You may struggle to sell due to the short ownership (I lost my job is a common excuse to sell a dodgy car on) but someone will buy it.0 -
It would be nice to see someone get one over on WBAC but it would be a slow drawn out affair, all in writing. If you can't afford to do this, you will have to suck it up, they are unlikely to buckle and transfer the money to you anytime soon.
You could always let it run through the Auction house where it is now, stick a £6.8k reserve and see what happens. WBAC aren't well known for paying over the odds so they must have been confident of making a profit from it.
That also avoids all the Tax/Insurance hassle.0 -

The OP has already confirmed that if you read the thread.
There were no significant faults, it had a major service within the last 300 miles. It needs to be sold as now unemployed with no savings. Yes, could have got more selling private but WBAC shout about how easy and quick their service is and how quickly you can have the money.0 -

Although BMAR do and they will collect. Might be an option but will see what comes of the legal advice first after they have looked over the contract.0 -

Where vehicles have been owned for a short period of time, we request additional documentation from the customer. Our experience purchasing in excess of 750,000 cars to date shows this is the only way to address legal concerns regarding the short ownership period, or identify if a car is being sold to us with undeclared accident damage (e.g. an insurance write off). As long as our customer can produce adequate proof of purchase, for example an invoice from a recognised garage/dealership, we can still purchase the vehicle.
Unfortunately in Hefferzzzz case, this evidence has not be produced. If we were provided with this then we would be happy to proceed with the purchase.

Thanks for taking the time to respond.
Except you didn't request it before the contract was made. You requested it after the contract had been made, signed and agreed upon. To request it after the fact is outside of your own terms and conditions so you have no recourse to cancel the contract.
**Also the fact that two separate managers gave authorisation to proceed with the deal serves as further proof you accepted the short term ownership situation.
Probably for the best that you don't comment further as it is all with a solicitor now.0 -
