You must send a strong complaint to the BPA (copy the correspondence from DRP and POPLA (showing 'appeal still in progress'). All PPC recovery must be halted while a POPLA appeal is still being considered.

Important that you make this complaint as many PPCs drop the charge (or don't contest an appeal at POPLA) once the BPA come sniffing around. Adds another opportunity for you to get this charge killed off. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Even in your letter to the BPA don't reveal the driver . You write it as the registered keeper0 -
If they have mentioned Beavis they have shot themselves in the foot. Beavis has no bearing whatsoever on Hospital car parks and this is a blatant attempt to get you to pay by deceit.
Complain strongly to your local Trading Standards Officer, but only in writing, the BPA, the Hospital Trust, Pals, your Union, local paper and broadcasting company, and your MP.
You are now in the driving seat and are in a position to cost them a lot of grief, do not pass up on this open goal. You never know how far you can go until you go too far.0 -
Further update, I have sent my complaint to BPA this morning regarding all the above, I have been careful to ensure the email doesn't mention me as the driver specifically and have bullet pointed the arguments as you have all advised. I'll update further when I receive a reply
Just to clarify, the email address s.clark@britishparking.co.uk came back as undeliverable so I have resent it to Steve.c@britishparking.co.uk that seems to have gone.
Any idea how long popla appeals take? Mine is still awaiting infor from legion group since 3rd December, do they ever reach a decision or close an appeal if the PPC don't ever bother to submit their side?
Many thanksAug GC £63.23/£200, Total Savings £00 -
Just had a reply back from Steve Clark, he stays he is very sorry to hear of my problems with legion group but apparently doesn't get involved in investigations of this type however he has copied in someone called Jill Cavanagh who is a senior investigator to commence work on my case. Jill.c@britishparking.co.uk for further reference.
I'm very impressed with his prompt reply though!Aug GC £63.23/£200, Total Savings £00 -

That might be all you will be impressed with, though. Hope not!

GD is referring to the fact that The BPA is just an old boys club for the benefit of and paid for by the parking companies, so they are prone to be biased in their favour rather than yours.0 -
Thought I'd update this thread, well legion group got their knuckles rapped by BPA for continuing with debt collection while I had a popla appeal in progress, although they claimed It was an oversight.
But yesterday I received notification that popla have decided in my favour and I have won the appeal, based on the fact that legion group never sent any evidence to defend it.
I'm absolutely thrilled and wanted to thank everyone who helped me, I am amazed when I talk to people at work how many of them have received 'fines' from this parking operator and just pay up without contesting it.Aug GC £63.23/£200, Total Savings £00
