As Nike would say - just do it.
Whatever you put won't get this cancelled at initial appeal stage; just see this as a method of extracting a POPLA code. You're wasting too much intellectual energy attempting to gild the lily at this point. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

ok Im going to save what ive written for popla. For now Il send them a very small basic letter.
Im just struggling to get all my points together. The reason being, as the circumstances are different to others who have been nabed by these people at this location.
thank you tho0 -
can these points be used for failing on POFA and keeper liability? (part I have marked in red)
Firstly, it fails to state the period of parking: paragraph 8(2)(a)
Secondly, it fails to identify the creditor and specify how and to whom payment or notification to the creditor may be made: paragraph 8(2)(h)0 -
You can see my comments.
GPEOL is now under a Supreme Court case (Beavis) and where is the "No Contract with landowner" important appeal point?
GD, so should I remove the GPEOL point then? I have now included 'no contract with landowner'. I have also sorted out point one but Im unsure whether to include the points about a failure in following POFA in the NTK as:
Firstly, it fails to state the period of parking: paragraph 8(2)(a)
Secondly, it fails to identify the creditor and specify how and to whom payment or notification to the creditor may be made: paragraph 8(2)(h)0 -

Again, it doesn't matter at this stage what is and isn't in your appeal. You just need to send something and demand they cancel or give you a PoPLA code. All the detailed stuff you will need is for the PoPLA appeal so just get something out before the deadline. Don't worry about the detail, just submit what you have making sure you haven't revealed who was driving. No, "I did this" or "I didn't do that." It's, "the driver did this" or "the driver did not do that."I married my cousin. I had to...I don't have a sister. All my screwdrivers are cordless."You're Safety Is My Primary Concern Dear" - Laks0 -
thanks for ur input guys!
I got a reply, which was quite detailed which i didnt expect. They answered nearly all my points and it seems convincing. Anyway, it was obviously a rejection. Therefore, do I start a new thread for the popla process?0 -

hi yeh they are offering the reduced 60 pounds again. Before it would have been 100 pounds, as appeal was sent after reduced amount period.
Il post the reply tomorrow and im guessing il have to start a new thread0 -
Don't start a new thread, stick to this one. It is easier if all the information is in one place. Starting another thread means that there is a chance people will need to go hunting around for this one to see what he happened before. That may put some people off .0
