Thank you, and I can very clearly see where this is going to.
You see I have never had to go that far as my tickets have always been cancelled by the supermarkets, hence I get the same for my friends etc. That is why I constantly push for people to go direct to the CEO.
I do hope you will understand that when I read a statement from a poster, without knowledge of who the poster is, a question is then raised hence my question to them.
Guess this will apply to most, especially the newbies.

I've been trying to get one of Troy boys emails, but the lady at the Aos keeps telling me my appeal is with POPLA, even though I've told her it isn't.
I've tried quoting the BPA CoP section 22.15 but it all seems to be falling on deaf ears. Se says the time allowed for the appeals is down to POPLA, but it must be somewhere in the contract with the BPA I would have thought.
The suggestion that the BPA just allows all the appeals will not work, as I can't see the PPC's writing to everyone saying "sorry we didn't really mean to give you that invoice".
Anyway back to the waiting game. Hope you all have a Happy New Year.0 -

This is what Steve Clark told everyone about the change to new POPLA. And the 28 days + postal time is in the contract.
•‘Business as usual but better’ – Gregg Hunt of OS
•As things stand no material changes to process
•Motorists must appeal to the operator first – 28 days to do so.
•If the appeal is rejected, a 10-digit POPLA verification code must be issued
•Motorist will have 28 days (+7 for post) to appeal to POPLA.
•POPLA will register appeal, request evidence from the operator and agree date for assessments
•Motorist and operator will have opportunity to comment on each others evidence
•POPLA will adjudicate and send decision to operator and motorist.
•Decision is binding on the operator
There is similar information about where Gladstones explained to the DVLA why they were using 21 days rather than the 28 that the BPA decided.

Does anyone seriously think that this is not going to end in farce?
The BPA, not renowned for its organisational skills, has got itself into a mess which needs a lot of money to sort out. The only way forward, afaics, is to pay an organisation able to take on this task a lot of money to sort it. It will also no doubt have to pay some of its members some sort of compensation. It appears to be unwilling to do either,
Appellants have a right to s speedy and fair hearing, If the BPA cannot provide it, it should also compensate them. Could this be the end of the BPA?You never know how far you can go until you go too far.0 -
My problem, as a layperson, is understanding where the 'rights' of an individual sit within the law in this situation.
I guess any judge would assume there is 'an appeal process' which we have all had to abide to, and would assume it has been followed.
In our cases the BPA, in my opinion, are denying us that right but we can not demand it.
It would be nice to be able to kick some a!!!, but with the BPA it would be like trying to kick Beyonc! in full twerking mode.0 -

The BPA are certainly trying to deny us that right.
However, the terms and conditions of any BPA approved operator’s contract with motorists include a promise to provide POPLA as the standard mechanism for dispute resolution; this condition cannot be amended unilaterally by the operator nor by the BPA.
We have already written to Mr. Troy to advise him that at this stage we are not satisfied with the BPA's proposal to appoint an independent service provider to act as it if were POPLA. Supermarkets are losing out imo because they offer too much choice, and carry too much stock. They are selling humous with added chick peas, (the main ingredient is chick peas) potato crisps with horrible flavours, and adding chili to everything. What are key limes !!!!!!, and why do they put them in cheesecake?

Thanks for the info Edna but I am still unsure what is 'binding' and what is not.
We all know the PPC's do not adhere to the BPA's CoP. so any so called contract isn't binding as such.
For example the only way that POPLA can be made to adjudicate within a reasonable timeframe would be to take them to court and make a judge give a ruling.
You would have to do this for every 'rule' in the CoP.0 -

Not drifting off topic at all, old fellow, merely adding some balance to the unsubstantiated statements which are constantly voiced on this subject.
Whilst I am sure that agressive parking management may be a contributing factor to the decline in supermarket sales, I believe that it is a minor one.
As for the hunt, the noise, the alcohol, the sweating bodies, the throbbing beast between one's thighs, who would not be looking forward to it, it is the best aphrodisiac there is.You never know how far you can go until you go too far.0
