Tenant question

Please can someone give me some advise. This is all very raw at the moment and I'm angry. My Mother sadly passed away on the 7th Sept. I had to clear her flat and pass key back to the council. Before she passed away she won a draw that the Council do monthly for £75 of vouchers. She filled in the paper work and was so excited to have won. I posted it for her. A message was left on the phone and I returned the call. Saying sadly my Mum has passed away.
My Daughter has just given birth on The 23rd to my Mums Great Grandchild, So could the vouchers be passed on to her. Person on phone said one moment I need to speak to Manager. She then came back and said NO as tenant no longer here cannot be passed on. I am shocked.
What would you do? I know it's only £75 but my Mum won them and she was so looking forward to meeting her new Great Grandchild which sadly she never got the chance. I just think it's disgusting.

    The first thing to do is look at the terms and conditions of the monthly draw and see if it says anything about having to be a tenant of the property to participate/receive the prize.

    Not sure if the win was after her death or before.

    Then go from there using the terms (or lack of) as evidence that she should have received her winnings.

    Then write to council setting out the reasons why this money should now become part of her estate.

    Who is the executor of her will?

    I would be calling their bluff and tell them - "After taking legal advice, the vouchers form part of the estate and should be sent to the executors as soon as possible".
    If the "prize" was awarded before your mother's untimely passing, then the vouchers would indeed form part of her estate.

    For £75, it isn't really worth much time and effort to get the vouchers out of the council - That said, they may decide that it isn't worth getting involved in a fight and just post them off to you.

    Having just googled about prize draws and looked at the terms and conditions most of the vouchers seem to be given in exchange for money off something. e.g. electricity bill.

    So as well as looking at the terms and conditions can you tell us what the vouchers are for?

    Also, in many of the terms and conditions that I looked at it says that they are not 'transferable'.

    So, what kind of vouchers are they that they can be used by your daughter?

  • Thank you so much for your reply. Never go as far as terms and conditions, because she won them in the July draw Mum sent of the form from hospital they then phoned three weeks later to ask what vouchers she wanted as they gave her a choice of many, the ones she wanted they don't do anymore. So I said I'm so sorry my Mum has sadly passed away, could they be passed on to her Great Granddaughter who had just been born. It was just the way they said it. If tenant no longer her then no. She never had a will so I'm dealing with everything. All she had was a loving family. I miss her so so much. I just felt that the compassion of the Council was heartless.
  • I Agree I will not chase the Concil for them I just think it was heartless the way they handled it. She never had a will but was so happy to win them in the monthly draw that the council do for people who always pay their rent. :-) I just really wanted to carry out her wishes for her, least I can do for her I Love her to moon and back and miss her more. X
  • No terms and conditions as she never got them, they wanted to know which one she wanted the left message on the phone to make contact. :-( once I said she had passed away so did the vouchers. It was the way it was handled that made me angry. After all she won them when she was alive. I know it's not a lot it's the principle of it. Thanks again X

    She could have what ever she wanted. Asked for ASDA but do not do them anymore so left message on phone which I got and asked what she could have then told them sadly Mum had passed away, so was told basically so had the vouchers. :-(

    Sorry for your loss.

    I would name and shame the council concerned! The win had been budgeted for and it matters not a jot to them if a relative receives them. I would let your local paper know, I'm sure they'd love the story.
