I'm sure that if there were a trademark issue, the band would have taken action.
The CPRs dont rely on the original band having a problem with it.
Its (as i've been saying all along) whether its likely to mislead the average consumer or not.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
Bands and companies are 2 completely different things. If you have a tribute band they can have a very similar name to the real band. I know of a tribute band called Mentallica, now if you were to glance at it in a hurry you might think it says Metallica.

Sorry about you purchasing the wrong tickets OP, but you just have to be more attentive next time! I've accidently booked the wrong venue for a comedy gig before, it was my mistake, I accepted it, but I bought tickets for the correct venue and then emailed Ticketmaster what happened and they kindly refunded me, even when they had no obligation to refund me.
You can always try and get a refund from them, don't play the blame game as that won't get you anywhere. Just state that you saw UK Foo Fighters and thought it was Foo Fighters in the UK. If you accuse them of misleading you they might not give you a goodwill gesture of a refund.0 -
Totally disagree, Mentallica and Metallica are one thing but having the UK in front of their name could easily mean the fact they are playing in the UK.Bands and companies are 2 completely different things. So this could easliy be misconstrued. If they had another word infront of their name rather than a location then yes but not in this case.0 -

The limitation about causing confusing with a competitors product/service isn't just on registered companies - its all traders. However, many bands are set up as limited companies for tax purposes (just like many other businesses).
And as I previously posted, the information provided by the trader can be factually correct but will still breach the CPRs if its likely to mislead the average consumer.
Now, if they're not registered companies, they are still "trading names". And the CPRs specifically says:7.10 Commercial practices are also prohibited as misleading
actions if they:
• market a product in a way which creates confusion
with any products, trade marks, trade names or other
distinguishing marks of a competitor,

Just an update....
While admittedly I will be extra cautious and attentive while buying tickets in future on this occasion they have upheld the refund. I explained the situation to them and put emphasis on why I couldn't understand that for the same concert it was worded differently, specifically for Glasgow and the omission of 'A tribute to American Rock Legends'
It took a few back and fourth e-mails. Originally I was told to pass the tickets onto friends/family members as the concert had not passed it would still allow them admission. I then responded to this with a bit of confusion as simply 'passing on' the tickets was a breach of the t&c's clearly stated on the back of the tickets. (i.e the purchaser has to be ticket holder)
I had by this point accepted my mistake and was just going to let it be. Yesterday had an e-mail stating while it should have been obvious I was purchasing tickets for a support band they would be upholding my complaint and issuing a full refund. They do not admit mis-leading or mis-selling in the e-mail however I cannot stress how pleased I am with the outcome.
The site still reads as follows: (some venues stating it is a tribute and some not for the same concert)
